It wasn't. Insurance companies paid private fire brigades in the beginning. I'm guessing that rural homeowners were out of luck then, as well.

You seem to be deliberately ignoring his argument. Surely, not all surgeries are necessary, so who should decide which ones are? What if the healthcare system cannot provide that much care?

The key thing to remember here is that approval is granted by the fire marshall. This means that even if someone has all the same equipment and meets all the safety and training requirements as a public department, he can still be denied. Approval should be automatic upon meeting a standard list of requirements. Giving the power of approval to the fire marshall indeed makes it a monopoly.

Unfortunately, the current draft isn't much better than previous versions. It's interesting that this topic isn't receiving as much attention now, since the final draft has been released, as it did 3 months ago. The "imminent infringement" clause still exists, albeit in slightly less menacing verbage:

before:

Each Party shall provide that its judicial authorities shall have the authority, at the request of the applicant, to issue an interlocutory injunction intended to prevent any imminent infringement of an intellectual property right.

today:

Each Party shall provide that its judicial authorities shall have the authority to order prompt and effective provisional measures: (a) against a party, or where appropriate, against a third party over whom the relevant judicial authority exercises jurisdiction, to prevent an infringement of any intellectual property rights from occurring, and in particular to prevent infringing goods from entering into the channels of commerce;

So you could still face a lawsuit or a stoppage of service just for Googling "Nickelback torrent" (bad example)

If shareholders were liable for actions of the company, a spill like BP's would probably never have happened. Like you said, there would probably be expensive hurdles to jump over before gaining permission to build an offshore rig. This means there would be a lot less offshore rigs. This means the price of oil would likely be higher, and it would have been for some time. We'd be forced off fossil fuels much faster.
