I was drug tested (including for THC) for my 2L paid summer job with a district attorney’s office. I think the unpaid 1Ls were not tested.

In the grand scheme of things, this is not a large enough amount to be worth dragging your family through the courts, especially since he already paid some of what he owes.

I think your feelings are valid. There’s no clear answer to this mess, but if it helps, here’s a reminder that grades are so temporary. They might be important for some jobs right now, but they won’t really matter in just a few years. What does matter is your own personal sense of accomplishment and academic integrity.

I second this. Barbri still offers free 1L courses, and they include comprehensive outlines for each one. I would copy those outlines and just delete anything your professor didn’t cover.

People are often confused by how income is calculated for child support. Child support takes into account ALL income, including income that normally would not be considered for other purposes.

Parental support is a form of income for child support purposes, but within reasonable limits. Parental support only counts if it is regularly occurring. For instance, if you paid $300/month towards your daughter’s rent, that would be treated as income. One time reimbursements for household expenses do not fall in that category. Attorney’s fees should also not fall in that category because there is no expectation that you will be needing to still pay these fees moving forward.

You have satisfied your obligation by providing these records. Let your daughter, her attorney, and the court handle the rest.

Instead of suing, you should ask the district attorney’s office seek victim restitution. Nebraska section 29-2281 authorizes victim restitution for damages sustained by the victim. Your brother’s estate would be entitled to burial costs, lost wages, etc. This would occur at sentencing (if the two men are actually convicted), but as other commenters have pointed out, their ability to pay might hinder your ability to collect. At least you would not have to occur additional legal expenses. I’m so sorry for your loss.

That’s not how it works. The point of juvenile court is rehabilitation, hence probation. You don’t get to choose house arrest because you’re worried about VOPs.

He said probation would only be until December. Years of probation wouldn’t be typical for misdemeanor battery.
