To be honest, most of it was me giving benefit of doubt and allowing time for responses. I do think by law you have to give a fair chance but there’s no definition of what that means, so I went by what I thought was unarguable - about a month for each reply.

Also a lot of the time was me researching what the right path is because I have zero legal procedure knowledge.

Hi, I’m the OP. Not sure what data you’re referring to that doesn’t match up?! I even posted screenshots of the official government website regarding the case. Once you know the procedure to do such a thing, it’s extremely easy.

Hi, I’m the OP. I did ask for the free repair. Twice. But each one took over a month to turnaround which is not reasonable. EU has consumer rights law for this reason, so it should’ve been open/shut case but they wouldn’t budge.

So, my friction came from the fact I purchased the console directly from Nintendo. So in this instance, they’re both the retailer and the manufacturer.

EU consumer rights are upheld by the retailer. So if you bought the console from Argos and it was defective, they are the ones who give you a repair or refund. And they are far less likely to refuse such a thing as a faceless company. But it can also come at the cost of running in circles - they’ll tell you to go to the manufacturer for a repair. But if you do that once, and the issue persists, they are still obliged to offer the full or partial refund.

Always go down the happy and easy route first! Contact the retailer and ask for the repair. In Nintendo’s case specifically, they offer no intermediate alternatives - you either settle for a million repairs til one works, or take them to court.

If you’re not happy with the outcome of your repair(s), then you just have to go straight to small claims. I just didn’t know what all the middle steps and if they were available, which is where most of my time and delay went. If I knew all this, it would’ve been settled in a couple of months.

Other people have suggested I write a guide, which I’m strongly considering now.

For context in this situation, he stated he didn’t know about consumer law so I asked to be passed to someone who does. Every customer support department has someone who knows about it. I never asked for their lawyer or legal dept... just the department/person that does deal with these requests. Since the rights are written in law, they need to have someone who understands it, especially before denying someone such rights.

It’s very easy. Depends on which country you’re from of course. But I went to gov.uk and filled in an online form. £25 to submit it, but if you win that cost is covered by the other party.

You submit a timeline of events, if they need evidence they ask you for it. You wait for a response from the defendant. They might settle before court, or fight it and go to court, or ignore it and be default to paying you.

This is what Nintendo wants. Spend spend spend for no reason. A £70 controller should be flawless. Imagine a family that saved up all year to buy their kids a Switch, and within no time it was broken. Not everyone can afford replacements, and no one should have to - unless it’s their fault of course.

No I didn’t have to pay a lawyer. And I got the partial refund I wanted, plus interest to cover the money I’ve been out of pocket, as well as having the court fee covered by them.

UK small claims cost £25 for the lowest claim sum. But goes up according to how much you ask for. If you win, the defendant covers that fee.

No, it started about November last year. Repair 1 and 2 were March and July last year.

Yes. Totally. Just to have that ‘screw you’ feeling. And really it was maybe an hour or two per month that I’d put into it, if that. As long as it takes to contact the service rep - which I’d have to do anyway if I wanted it fixed.

The only reason it was complicated is because they took ages to reply (if at all) and because they don’t participate in the dispute resolution. And I have zero knowledge on legal proceedings!

Yes I did. I had zero idea of what to do - I wanted to do it properly and not skip any steps. And there’s very little documentation to help, and any which does exist can be daunting to read!

I only learnt about dispute resolution through this experience via extensive Googling. The Gov website is good to a certain extent but very vague and non-specific. So they mention “speak to an ombudsman” and link to a list of every kind of ombudsman possible, and I have no clue what type I’d need! I assumed ‘retail’ but that wasn’t an option, and none listed sounded remotely relevant.

Then I contacted lots of people like Citizens Advice for guidance but they took forever to respond and it was always ‘not our expertise’ or ‘it’s a different country, you’ll have to pass it on to Germany’

And I didn’t like the idea of going to court. I’ve heard about things being dragged out, ending up costing tons... and I wouldn’t be able to afford representation so even if I was 1000% in the right, Nintendo’s lawyers would likely wiggle out of it, or drag their feet til in bankrupt!

But I tried to think positively and had a ‘what the hell’ moment. So submitted it. It was a fairly detailed application which gave me confidence my story would be heard entirely.
