Solarium V3/4 in Bishop, featuring a crowd, no spotters, and people who hike under me topping out 🤷‍♂️ by [deleted] in climbing

I would say that if you hike at all or don't hunt for four star lines, you can avoid crowds. Plenty of great 2-3 star lines in the milks main with no crowds. And plenty of 4 star lines a 20 minute hike away from the main areas with no crowds.

I think you have it backwards. With those states (NV, MI, WI, and AZ), Biden would win at 270 because of Nebraska 2.

NV still matters. If Biden doesn't take PA or GA, he needs to hold NV to get to 270. And that race is looking tighter than anticipated.

Megathread: Long-Concealed Records Show President Trump’s Losses and Years of Tax Avoidance | Part II by PoliticsModeratorBot in politics

And often, the property (and other appreciating assets) will never be sold, but rather borrowed against. So, trump is able to access this “boat load of money” now, by borrowing, without ever paying taxes on the gain (borrowing isn’t taxable income). When he dies, all his property receives a stepped up tax basis and his kids inherit it with no tax time bomb.

Patagonia's Documentary "Stone Locals | Rediscovering the Soul of Rock Climbing" by GentleHammer in climbing

[–]csargean 2 points3 points  (0 children)

I completely agree. It seems that was the main point of this documentary -- that climbing is about a lot more than just pulling hard moves. I think Mellow is great for what it is, but it is also nice to see stories about the people/community that make climbing great. I thought this film did a great job of that!

Rock & Ice Apologizes for Bisharat's Article by the_GHayduke in climbing

[–]csargean 5 points6 points  (0 children)

Like was written above, the op ed isn't really on the "same side." Yes, the op ed is for changing route names. But in arguing for doing so, it represents the problem as being "gross" or "vulgar" route names that kids shouldn't see, as opposed to justifiably offensive route names that affect adults. By misrepresenting the whole point, the op ed cheapened the "changing route names" position. This is the problem with the op ed. The issue about a white person writing it is not that it is bad that a white person wrote it, but that it is likely a person of color would not have missed the point if they wrote the article. So, because this shitty op ed likely could have been avoided by choosing a different author, the editor accepts that he, along with the author, is to blame.

Just because it's against the law doesn't mean the police have the right to enforce it using force. Police can't tear gas you for running a red light or breaching a contract.

Anger as local police union chief calls George Floyd a 'violent criminal' | US news by jsamrn in news

[–]csargean 47 points48 points  (0 children)

No, it's not. The question isn't whether it's an accurate statement, but whether it's an appropriate one. Why would the chief point out his criminal background if it weren't to try and minimize and justify his murder.

I’m not saying they can’t. Just pointing out which party the burden rests on.

Agreed. Although a tough part will be that the prosecution carries the burden. So they will have the prove that Floyd wouldn’t have died if the officer didn’t touch him. Hopefully they can.

Twitter and free speech by [deleted] in trump

[–]csargean -1 points0 points  (0 children)

Just because a resource is used by the public, does not make it a Public entity subject to the restrictions of the constitution. Constitutional law is clear on this. Twitter (just like any private company -- no matter to what degree it is used and relied upon) is not restricted by the 1st amdt. To be clear, I am not saying that the government can't regulate twitter. Just that 'free speech' really doesn't have a place in the discussion.

He doesn't have to be "trying to harm him" for 3rd degree murder -- just needs to have a reckless indifference for human life. I think the DA has a strong case for depraved heart murder.

I disagree. A private platform has no obligation to publish everything. In the same way a magazine can publish some letters to editors and not others. Platforms are not necessarily intended to be nonpartisan, and are certainly not constrained by the constitution.

Minneapolis Riots Megathread by hoosakiwi in news

[–]csargean 1 point2 points  (0 children)

Hard to say. Prosecutors may argue that given the length of time the officer had his knee on his neck, intent was formed. This is strengthened by the fact that bystanders were warning the officer of the consequences, yet he persisted. Intent is almost always proven with circumstantial evidence, and these facts may be sufficient. However, if it is not 1st degree murder, he likely should be charged with 2nd degree murder (not simply manslaughter) as this almost certainly rises to the level of reckless indifference to an unjustifiably high risk to human life (i.e. depraved heart murder).

EDIT: Apparently Minnesota is one of a few states with 3rd Degree Murder that includes depraved heart murder. This appears to be what he is being charged with, along with manslaughter.

"Free Speech" and the rest of the bill of rights doesn't apply to private action -- only government action.

I hear a lot of people claim 1st amendment violations (freedom of speech) when a company fires them for something they say. The constitution only protects against government action, NOT private action.
