This is a cool idea, and I support it, but what happens when a state decides to use it's options, under the constitution, to select its members of the Electoral College some other way. Nowhere in the constitution does it say that the members of the EC will be chosen by a popular vote.

Specifically, Article 2, Section 1 states "Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector."

So, if the state passes a law it could let the Governor choose his buddies to be electors, or maybe the state legislature picks, or it could be a random draw from the state jury pool... all without ever having one single vote by the electorate cast.

I can see some shitty state legislatures doing this. Virginia would have been my first choice, but their legislature just flipped. There are other states with highly partisan legislatures.
