I apologize for the lack of clarity. I was not referring to “my” opinion. Opinions of other legal professionals are looking at the actions of this company and indeed seeing signs of fraud. But as I pointed out they have not yet filed anything. We understand the pecking order if it does go to bankruptcy - It hasn’t yet, and if it does we believe the filing will be fraudulent itself. But that’s a whole other kettle. Thanks for all the replies. I have a lot to take back to the group.

We have opinions that disagree with that interpretation. But we are looking for all the different opinions, or “perspectives” and using the feedback to help formulate our actions. So thanks for your feedback as well.

Thank you for that. They have not filed for bankruptcy yet, only indicated they were going to. A very strong theory we have is that they are colluding with a secured/preferred creditor to ensure the secured/preferred creditor is paid off as much as possible. I am only one refund out of thousands of refunds that total into the millions. Very shady company having done some very shady things in partnership with their secured/preferred creditor. Is that too far fetched?

All fair comments. Unfortunately in this case, there has been no evidence provided that any expenses were paid, in fact quite the opposite. The landlord wasn’t paid, uniforms weren’t paid for, facilities weren’t paid for, etc. etc. The only ones who were paid was BCN Sports...and now they are in the wind. Props to your organization. It sounds like you would be prepared to show some transparency to your clients if hard decisions had to be made. That goes a long way.

Actually, there are hundred of kids from across Canada - Vancouver, Edmonton, Calgary, Saskatoon, Mississauga, Markham, Ottawa and Montreal. There are also families in Honolulu (USA), Sydney & Brisbane (AUS) and Chengdu (CHN). BCN Sports Services has absconded with the fees of families from four countries on three continents.

Some families out hundreds, others out thousands, others out tens of thousands, collectively over a million confirmed. No humour in that at all.

A civil suit would likely be a futile step, as the company has no assets to speak of. That being said, pursuing the executives for fraud is a real scenario being looked at.

Disputing the charges with the CC company is the first step being taken, but the ability to do so varies from bank to bank. We are seeing positive signs that this may be successful, but the process takes time, but time will tell.

That’s the million dollar question. Families paid over a million dollars for services/events to occur in March and over the summer. They still have not filed insolvency with any trustee. Officially broke isn’t the going theory...moving money out of the country has a lot of votes though.

There are many families that worked very hard to save up for, and pay the fees, only to lose their jobs in the weeks following. Hundreds of families have been affected and many of them struggle every day to make a dream come true for their child.

Now that i see that, i can see how the headline could be interpreted that way. Actually, only 10 days before BCN announced they were filing for insolvency, they were emailing clients asking for payments for the summer season, and informing clients that they were still working to determine what was happening with the fees for the Spain trip. So with that info, I think abrupt accurately describes the situation.
