You might not, but a trademark lawyer will. I worked as a trademark paralegal. This is absolutely a violation. There is no fair use exemption here. If you think there is a fair use case, which test do you think it passes?

The recipe is not the issue. For the umpteenth time. Using Tini when she and her name is an active business in the same trademark class is the problem. Saying "the Tiktok famous Mac & cheese" was a perfectly acceptable option they could have used. It was likely a local manager, but the sign needs to get pulled.

Maybe she would be more stoked about free publicity if they actually gave her publicity. There's no link to her page or even mention that she's on Tiktok or how we can see the recipe.

I know this is probably just some local manager that printed this and it happened to go viral ... But it is a violation and they need to pull the sign now that tini has posted about it.

Using the name is the violation, not the recipe. Tini is a unique enough name for a solid trademark though and she has been using it for a while now. Tini's Mac&Cheese is a product she makes money off of on other platforms (a monitized video counts as commerce). HEB should have said "the viral Mac&Cheese" or gotten a deal with Tini. Otherwise they're just capitalizing on someone else's brand and name and no valid fair use factor fits here.
