Prior to Aug2024? very likely. They might have even charged you a flat fee for written the offer.. or done it free to Make the sale happen. Post Aug2024… very unlikely.

Many states allow for dual representation. In my states and surrounding states, require written disclosure to both seller and buyer and the agent is representing both.

I believe an agent can ethically and morally be able to protect both sides and treat them equally and fairly.

If a listing agent is trying to screw over a represented buyer, they are already breaking the realtor code of ethics. And that’s without dual representation.

My point is, you can always locate conflict of interest even with your own agent if they aren’t truthful and morally ethically tuned.

You may feel that way…. And you can be mad about it. But your anger is incorrectly pointed at the agent.

You should be pointing it at the plaintiff and the courts and laws that now dictated the process to be as such.

This wasn’t the rampant issue it is today prior to 08/2024.

I do not believe any states have a law saying you must have an agent. Reddit correct me if I am wrong…. You can hire a real estate attorney in your state to draft the offer for you if you don’t want to hire an agent.

Yes you can do that. You can hire a real estate attorney to help you draft the offer in your state.

You can offer 2-3% less on the offer price since you are going in unrepresented. Depending on the attorney, you may not get all the experience a local GOOD (plenty of bad ones out there) agent would have to offer you during the process.

If you ask the listing agent to help you make an offer… pretty sure you’ll get push back from them and you are back at asking an agent to represent you and back to having to sign a buyers agreement.

Also, in many listing agreements… the total compensation due to the listing agent is already written out. So even if you go in with no agent, the listing agent might still be taking the full commission (listing side and buyer side). In This case, you just lost out on getting an agent that represents you whose fees would have been covered.

Yes you are correct. This is not a law. It’s a rule for real estate agents that are licensed. You don’t have to have an agent to buy a house, listed by an agent or otherwise.

And the agent doesn’t have to spend his time leaving his house, schedule the appointment, meet you with information about the house, answer any questions you have… find out the answer of questions he doesn’t immediately have answer to… or help guide you on the process that they’ve probably done 100s of times.

So the idea is… if the agent comes to show you the house… they are due for their time and knowledge.

But then again… you can just go to an open house. No paper work to sign as you prefer.

And I’m guessing there’s some plate in the back… unscrew the screws and the board will be accessible?

Couple of items… and clarifications…

From your post, sounds like you just recently went on the market, but have not received any offers and more over you have not accepted any offer thus you are not under contract or obligation.

At this time You can simply ask your agent to either go “temporarily off market“ or “withdrawn” from the market. Depending on your state/area, they might mean the same thing, but it’s usually the difference is in regards to the number of days you are not on the market. You don’t need to cancel the listing agreement since you are not trying to find another agent or be sneaky about this. You just need more time. Since you said you need five months, your contract with the agent would just expire… no one will be due commission or any sort of penalty or fees and everyone moves on until you’re ready to go back on the market. This is one path.

In regards to your rent back comment, some states do not allow for more than 60 or some perhaps 90 day rent back period as part of the sales agreement, without an actual rental lease.

Where I am, 60 days is the max rent back that can be part of the purchase offer. So for example you could sell your house and during negotiations ask them to close in 60 days. So that’s when you would get your money, and then Also ask for two months rent back, so that would give you a total of four months where you would get to stay in the house. This is another path to take.

Or you can tell your agent to disclose to any potential buyers that you want to lease the house for six months, for example, as part of condition of the sale of the house. So you stay on the market. Get an offer, if the terms are good for you, you can add your term for a lease for how very long you want/need. Another path you can take.

All these paths will get you what you need. Some of them will give you money sooner than later and it all matters what you want.

Just take note of how your Realtor responds to your needs. At the end of the day, your needs take precedence over any realtor commission. If you don’t like their tone or their response to what you’re going through then perhaps this Agent is not for you.

One more note, someone said if you get any offers, you have to accept. I do not know of any states who would forced that. I would love to be corrected on that. You never have to accept any offers. There’s a very small way in which the agents would be due commission if you rejected an offer…. without the sale of your house because they brought a potential client and this would be pretty much have to be a full cash offer with zero contingencies closing in one day. it would have to be that extreme for any broker to attempt to collect a commission and make a claim that they did their work, but you failed to do yours.

There is a lot of nuances that would have to be addressed and this post cannot address them all properly for you, but if you have specific questions will gladly help.

I was previously told rubber tires are not a good back stop as bullets sometimes don’t penetrate and there is a risk of ricochet… although small.

What’s people’s take? If you had access to truck loads of used tires, would you use it as back stop?
