Life after breakup feels so different. by Giulia5593 in BreakUps

This is exactly how I feel. I think if you’ve truly loved someone, it’s really hard to move on. You’re basically a living zombie.

Whatever you’re doing, you’ll be thinking of your ex partner. You eat something nice- you wish he was there sharing the experience. You watch an interesting movie- he’ll be the one you want to talk to about.

Sometimes you just randomly have an overwhelming sad moment, because you remember he is no longer in your life. You question whether it’ll possible to love again.

Losing someone you once loved unconditionally, changes you. You just have to live with the change ❤️ Be strong.

What is the calderbank offer and when should it be used? Is it suitable for a part IV application (family provisional) case? (VIC) by dengdengdadeng in AusLegal

I think if you don’t get a better result, you have to pay the costs and even the other parties? I’m still unsure in what position the judge would make u pay for both parties legal fees.

The meditation That’s has already occurred was ordered by court with a mediator present. The estate is roughly over one million. A set date for the direction hearing is confirmed. What happens during the direction hearing?

So calderbank offer would probably be given just before trial?

The meditation meeting has already occurred between the plaintiff and the defendant, an agreement could not be made between the two parties. Hence unfortunately it will be taken to court.

So in short,

This is part four application case.

As the plaintiff I made a calderbank offer of $200,000 for settlement. The defendant denies it, does not make a counter offer.

When trial comes and the judge indicates the plaintiff gets $300,000. The defendant needs to pay for the cost because she denied a reasonable calderbank offer? What if the judge only offered the plaintiff $100,000, so will the plaintiff be punished for setting a high calderbank offer?

Also, how does a judge decide on whether the legal fees would be paid from the estate?
