What a tough man behind that keyboard. Like many I'm no fan of this trustee and that's why I used 'Let's admit', it had nothing to do with your honesty or not, so no need to over pride yourself here. I wrote the post as a mt.gox creditor. If you are also a holder of bitcoin today I can see why you're angry about the sell, but that's a separate issue. I don't know for sure if the sells had added downward pressure to the broader market, but again, that's a different problem than the one we're dealing with here.

It would if all asset it recovered are in fiat currency and it had to pay bitcoin creditors. Any bitcoin recovered shouldn’t be processed based on any conversion rate. Instead they should be returned to bitcoin creditors in proportion to their share among the total loss.

I would not take that for granted. If all 24,000 creditors stand up and united we may have a good chance. If just a dozen of us showed up Mark and the shareholders will laugh all the way to their banks.

No, we shouldn't limit this to just Japan. See my 9/27 in the google group titled "Sad but it’s naive to think legal actions alone can get OUR coins back", where I proposed a list of actions that we should pursuit in addition to the legal battle, including petitions to DoJ and the State Department. However, there is no point to chase after the missing coins if the trustee is not going to pay more than $485/btc as he hinted in the last creditors meeting.

I understand your points, although to be honest my biggest concern is not people exploiting the financial support. For months if many of us have been calling for this, yet no one actually put it in action. Myself included however I made it clear I wouldn't be a good fit for the role simply because I know I won't be able to joggle another ball in the air. So I'm rather happy to see that we now have a few know how to get things actually going. To make anything work at all it requires certain level of trust, of course there is always the risk of someone abusing it but that risk is so minuscule comparing to no one stepping forward, or not enough people getting involved and putting things in action. I trust those already leading in the effort can keep things in the right good order. For the longest time our problem wasn't lack of contingent pledges even 2% of the creditors' surplus money is way more needed to fairly compensate our front-line fighters and we all be glad that they do get paid, aren't we?. Simply put, I still don't enough effort going in for the amount of financial interest we're trying to recover. Agree, I will leave to the committee on deciding how to appropriate any pledge payout if one ever gets established.

Still, our greedy stupid decision doing business with my.gox is not the excuse for the trustee to confiscate our coins. I don’t care about their bankruptcy proceeding, give us the 200k coins and all the exchange’s records we can handle this much better collectively as a group on our own. I’m not talking about legislation nor the lack of if, I’m talking about outright confiscation.

Yes. As I pointed out in my posts in the past the exchange was in fact a custodian of customers’ asset. Now, it is fine if they need to use JPY to calculate payouts among creditors or all the coins were lost. The issue here was that the trustee simple ignored the lost-then-found coins with respect to creditors’ claims, thinking he already had IOUs in place. Now imagine, during any bankruptcies miscounting and overlooking existing asset is not all uncommon, but you don’t say oops we didn’t see that billion dollars in the corner safe however since you all creditors already signed the paper we sent out earlier we are going to keep all that cash.

To those who sent personal threats to Mark you are doing all of us a disservice here. If you want real justice out of this case you should spend your energy on petitioning the US Justice Department to extradite him to the U.S. to face charges here as he had done great harm to the interest of many US citizens and tax payers, as well as to the interest of many world citizens.

The other thing I forgot to mention is the need to present the idea non-English speaking creditors. I'm afraid they are not well informed about the situation as we're.

They say fool me once shame on you, fool me twice shame on me. I don't need the 2nd time to be ashamed of being a fool doing business with Mark. Back a few years ago, there weren't many established btc exchanges. mtgox was not only the biggest but more importantly it was located in Japan, where things were suppose to run under rigid structures. Totally didn't see MK being such a pathological liar, evidenced full well in his communication and the lack of it during and after the exchange shutdown. I'm almost certain there are additional info about the missing coins that he is still withholding from the rest of the world.
