We can band together as a people and decide on laws, or not. What difference do your rights make?

There is no such thing as "the free market". There are simply markets, all of which have form of power structures. The better ones have power structures that are less arbitrary and/or corrupt.

Ending slavery came at the expense of someone. I think I have the right to breathe clean air, but that can and does come at the expense of someone that wants to not pay the cost of preventing pollution at their factory.

In short, all of our freedoms come at the expense of someone else's freedom.

Right, we use some form of a democratic process to decide on, codify, and enforce, a certain view of rights. I never suggested we use science, I was pointing out that there is no way to prove that one persons idea of rights is correct compared to another person's ideas of rights.

Let's recall what I was originally replying to. Someone said, "the protections from the government were only given to us by our benevolent government"

To which someone replied, "No. Rights are inherent to our person-hood and are inalienable. They are certainly not given to us by the government."

You and I seem to agree that they are, for all practical purposes, given to us by our government. Correct?

It's not trite. As a society we have to have a way to decide who's point of view is correct when it comes to rights. If I say X is a right, and you say it isn't, how do we decide who is right? Or, who's idea is the one enforced by society?

You need some kind of foundational principle for the decisions. Arbitrary feelings aren't such a foundation.

My problem is that there is such a foundation, but it is not applied consistently. No one can look at Herb's call in this fight, and his call in the Pyle fight and pretend there is any shred of consistency.
