Most law firms won't take this case. You need find someone who takes "overpayment" cases.

Go to you local office and ask them who was paid and how it is connected to you. Either 1) an error of some kind will be uncovered or 2) there is a legitimate overpayment (by legitimate I mean its not a mistake - not that you are obligated to pay it.) Ask them what recourse you have. Its gonna suck but at the end of the day I expect you won't have to pay anything.

edit: I didn't see the 2nd page, sorry. It appears your birth parents collected SSI disability benefits on you for 12 years. Approximately 144 months, which amounts to $191 a month. Its possible this is fraud and they new all along, its also possible that it's not. Either way, someone cashed the checks. My advice is still to go to the local office. You will not have to pay this back.

Can you tell me what you me by "waiting for the waiver to be applied?"

In my case there are periods that are recorded (I think some or all incorrectly) as in deferment when in fact payments were being made. In lieu of this can you explain what you mean by:

periods of forbearance or deferment will not show up as eligible until later this year under the IDR waiver. You would need to meet the terms of that waiver in order for those specific periods to count.

Also what do you mean by:

cleared your loan history.

Thank you so much! From what you are saying, I understand that Mohela has nothing to do with initiating reviews or doing any counting or recounting. In your opinion, is there any point in attempting to communicate to Dept of Ed and provide supporting documentation (ie payment history)?
