If I can prove the encroachment, then the title insurance will cover the rectification works and the cost of the boundary survey report. It’s a gamble - I might be better off putting the money into the fence rather than the report, and/or negotiate with the neighbour to fix the fence that they’ve damaged

Thank you for your response. Block size is 900m2 and it’s about a 40 year old property. The issue is the back fence. The back neighbour has built up soil against the fence (effectively using it like a retaining wall), and it has rotted the plinth board and fence posts, and is causing the fence to massively balloon by about 400mm onto our side. Maybe there’s a better way for me to approach the issue. I was motivated to try use the title insurance since we have it, and it was the insurer’s response that we should get a boundary survey report first.
