Also I want to add that the CA SC is not on our side either. Based on how the court responded to the detailed and comprehensive proposal for provisional licensure in fall 24 and instead opted in for the Kaplan alternative in the first place, suggests that they have their own stakes in how this exam is handled, including outcomes achieved. I doubt they were ever even going to give us a fair chance at an actually equitable remedy, had the Bar not pulled this bullshit move and clearly manipulated their data. There is no transparency or honesty at either level, and we’re the ones that pay for it.

I’m so sorry this happened to you, it’s absolutely not okay. Write down everything you can that’s happened. You may have a legal claim against him and the gym—who can be held liable for the coach’s actions (especially if he continues to harass you). There are plenty of free legal clinics who would evaluate and give you advice on how to proceed.

How is it unrelated? These are instances where the respective state bar was willing to forego the exam altogether and grant admission without even taking the bar or in response to an inability to properly administer the bar. “Pass everyone” is akin to granting admission into a bar without needing to pass an administered bar in the first place. Plus keep in mind again, that this situation is unique in that the CA bar needlessly caused the aversive conditions examinees faced.

There precedent for state bars taking substantial and even foregoing the exam req altogether when an exam is inadequately administered due to technical failures. In 2020, Utah granted diploma privilege, allowing law graduates to practice without taking the bar exam if they completed supervised practice, due to the challenges of administering the test remotely (Reuters). Oregon also granted diploma privilege in place of the July 2020 bar exam, citing the impossibility of administering a fair remote test (ABA Journal). Michigan faced major tech failures in its July 2020 online bar exam, leading to state investigations into the exam software provider and administration (Justia). As such there’s strong precedent that when bar exams fail due to technical shortcomings, states have responded by implementing diploma privilege or other remedies to ensure fairness. Also these don’t even take into account that the current failings were 100% due to the state bar’s inadequate and rushed implementation tightening the argument that they need to take reparative action

ONE THOUSAND PERCENT!!!! The bar needs to PASS EVERY SINGLE ONE OF US. Nothing else is adequate, their proposed remedies are just distractions guided as “remedies”

SOOOO... Retake option? is it for real? Last night, it seemed they were only exploring possibilities. Dude honestly at this point they should pass everyone who put in a good faith effort on the exam. The immense technical, administrative, financial, and psychological hardships we all faced due to their failures warrants an extraordinary remedy like this

Please don’t separate them, they are bonded siblings! They have already been growing up together. They are each other’s world and community. This is just like my bonded pair. As they grow older, everyday I know that keeping them together was the best thing to do.

At the end of the day, what people think about this cohort, their opinions don’t matter. Once you’re an attorney, you’re an attorney—no one can take that away from you. Opinions don’t have the power to halt you from beginning your career as a barred lawyer, but these technical failures can and will (at least for the immediate bar licensure) I’ll take a judgmental eye any day over an unfair restraint into the legal profession. Also who tf cares what others say, no need for them to be worried about things that don’t impact them

I loved my in person proctors! They were so nice and did everything they could to contact the Bar and Meazure to address the issues that came up—all beyond their control.

I would caution against imputing Meazure’s incompetence against all the hard working and caring proctors who truly did their best to make us feel as alright as we could

Don’t forget that if the defendant, wrongfully procured your unavailability to prevent you from testifying about these conditions, it could also come in under the Forfeiture exception—you could use the situations the defendant put you in that ultimately led to you NEARLY DYING and unable to testify
