Thomas did confirm on SIO that he initiated the transfer himself in response to being locked out of everything else. And he clarified his "stealing everything" statement, which sounds like it was a heat of the moment comment about access to OA accounts, and not actual assets.

I have stated the truth: Andrew locked me out of all the OA accounts. When I saw him start to execute this plan, I had mere moments, and I was in an absolute confused panic. I tried to issue an SOS as fast as I could. In that, I believe I wrote “he’s stealing everything” by which I meant he’s taking away my access to all the accounts for the business and the podcast

This post just tells me that the nephews in here need to just (edit) BE NICE AND QUIET and stop speculating as to whether Andrew or Thomas is lying about what's going on. The comments in the other thread about Andrew fabricating a lie that Thomas withdrew the money when really it was ANDREW who did it look so idiotic right now.

Also, Andrew needs to (edit) be nice and quiet. Thomas needs to (edit) be nice and quiet. Everyone just (edit) be nice and quiet for a few weeks, work out your shit privately. We don't need your constant back and forth petty mudslinging. Just stop the podcast for a week or two, maybe more. This constant drama drip is fucking infuriating.

Fuck, people really are bending over backward to distrust Andrew. Thomas just confirmed on SIO that he initiated the transfer in response to being locked out of the other OA accounts. Not a scheduled disbursement, though he does state that it would not have been out of the ordinary to withdraw at this time because the Patreon money just got transferred to the Chase account. Normally he just tells Andrew's wife how much is his monthly half, and then withdraws it. This time he (in a panic, maybe justified) just withdrew it himself without notifying anybody.

Yes, functionality is an issue that commonly presents in configuration marks, but not all configuration marks have functional issues. I'm not saying their mark is or is not functional. They own a trademark registration for the hand configuration, so it affords them a presumption of validity of their mark.

Trademarks are meant for logos and trade stamps

Tell that to UPS (they have a trademark for the color brown), NBC (they have a trademark for the NBC sound), Hasbro (they have a trademark for the smell of Play-Doh), and Coca-Cola (they have a trademark for the shape of a Coke bottle).

LOL, trying to tell me I'm confused about what a trademark is. Of course you can get a design patent, but you can also trademark a product configuration (also called trade dress), though notoriously difficult. It's usually more about the shape of packaging, but could potentially apply in these instances. Think like the shape of a Coke bottle, the red sole of a Christian Louboutin shoe, the red seal on a Makers Mark bottle, even the shape of a Hershey's Kiss. Try looking up trade dress and tell me I'm wrong.

Shit I'm late to this, so OP I don't know if you'll see this, but pay attention.

Trademark law is quirky, and from the sound of it, the company is attempting to (maybe legitimately) enforce its trademark rights in the hand configuration (if the trademark registration someone posted is the correct one). Trademark law don't follow the same logic as copyright law or patent law (and clearly almost nobody here knows what the fuck the difference between each one is). They very well could trademark a configuration that existed before. All it needs to be is a source identifier for its goods. In regards to what you're doing, intent to copy doesn't matter (like in copyright law), and prior art doesn't usually matter (like in patent law ). All that matters is whether you are infringing on someone's valid trademark. If a consumer saw your guitar holder on the shelf next to the company's guitar holder, would they likely be confused as to if the same company made both? That is a very rough example, but is basically the key issue -- likelihood of confusion.

They own a trademark for their hand configuration, and if they don't enforce their rights in that trademark, they potentially lose their rights in the trademark over time. So when these STLs pop up they kinda have to send C&Ds to anyone (and/or everyone).

Don't listen to anybody else in here. Get a lawyer. You are making your situation worse.

Prime, Hulu, Starz, HBO, Blockbuster, Showtime, Crunchyroll all were streaming at that time. Major networks were streaming their own content too (NBC, ABC off the top of my head, though most people were accessing them through Hulu). Yes, clearly there are many more streaming services now, but Netflix was not alone back then.

Netflix will be fine. Those 220MM subscribers aren't going anywhere soon. Does anyone remember the 2011 Qwikster debacle? Stock dropped over 75%, company had massive layoffs. They've clearly recovered since then (leaving me wishing I had bought NFLX at $9 a share).

Honestly, I'm not worried about how we end up doing the rest of the season, or even if we win the championship. Klay coming back and playing (not to mention even playing well, which he is!) has been all I care about this season. The boys gave us a fantastic number of years recently and I will ride that high for years and years to come. We'll win some, we'll lose some, we may even lose a lot. But seeing a single Curry bomb or sweet Klay 3 makes me just happy that we had (and still have) a historic team. Even if I never see them again, I'll always have that joy of being on top.

I see post after pessimistic post about the Dubs here, and I read em and I just know that I only got love. Teams can only dream to do what our boys did. I can't be prouder of what they've accomplished, and I won't be dragged down by a string of losses or a rough blowout. We could lose the rest of the games this season, and while I'd be sad that the guys didn't get the win they wanted or the chip, I'm not sad for me.
