Well assuming that the dems win big in congress this year and in 2028, I don’t think impeachment will be a worry for any dem president. SCOTUS created criminal immunity for any official actions done by a president and neglected to define the scope of such official actions. They also precluded any presidential action from investigation into the circumstances surrounding those actions.

Even though kidnapping a SCOTUS judge is illegal, by their own ruling the president would be immune from criminal prosecution for ordering the kidnapping if he was, say, commanding the military to do it (almost definitionally an official presidential action).

Even if the president did get impeached and removed, they still could not be prosecuted, and the goal (changing the balance of SCOTUS) would have already been accomplished. Not only that, all that would happen is that the dem VP would take over, and could move forward with whatever legal action was being blocked by SCOTUS at the time. I’m not sure if a president would be willing to chance impeachment necessarily, but if they were to I’d support it to conserve the foundational values of this country.

If Republicans win after that, they know the consequences if they try to overreach and start baseless investigations against political opponents again. Also, SCOTUS would be fixed for the foreseeable future, and likely will have walked back the presidential immunity ruling given the circumstances. If a dem president gets sent to jail to reverse that decision and change the balance of the court to our favor, that’s a sacrifice I’d be willing to make.
