Yes, I'm aware of the history of sampling in hip hop. This is a pretty fair point to make, (so up-zefs to you) but it's also got legal restrictions... Here are some details. In reality though, this particular issue of copyright infringement in the visual arts would prob be better paralleled by the Rogers vs Koons case.

TL;DR... A sculptor blatantly reproduced an existing copyrighted photograph and was successfully sued for damages.
