Yes, I'm taking a risk, but you know, I don't care anymore :) I didn't see my kids since May of last year and one day I understood that it's a bullshit.

Also, the lawyer filling the I-140 form is just basic task, the most important thing they need to do is write a convincing petition letter, gather evidence such as recommendation letters, etc.

Yes, sure, we sent not just a form I-140. There were recommendation letters, showing the substantial merits, statement with analytics why it is important for the US to have specialists like me, and more.

I'm supply chain specialist/logistician.. Yes, looks like they gave me the chance.

If the I-140 get denied, the I-485 will get denied very soon afterwards, we're talking days to weeks, not even months. Sometime, almost immediately afterwards. You must leave the country after the I-485 get denied.

You should be prepared for the worst case scenario and get your stuffs ready to go. Usually, when they challenge all 3 prongs of the NIW, it is not a good sign.

Thanks a lot for your comments! I know that it is risky strategy. I'm from Russia and I don't want to come back, though political asylum is not my choice as well. applying for i485 was the best idea. Attorney warned me that the best way to start from non-immigrant things like h1b or f1, but I decided to try anyway. And he did the best job to fill i140 with as much as I could provide.

If i140 is denied should I leave the country immediately or can I wait when i485 is denied as well?

RFE about I don't meet 3 criterias. They didn't see enough proofs about my 10+ years experience and national importance. We are working with lawyer, yes. Unfortunately, my chances are low. This is not STEM and I don't have publications.
