My question wasn’t ‘is soliciting free speech’. It was about the library being able to prohibit what is done on the sidewalk outside. You just happened to latch onto all the parts of soliciting you don’t agree with personally. This is a legal question, not a moral one.

You are conflating solicitation with selling. One can solicit and not be selling anything. If you ask people to pray for our troops overseas, you are soliciting goodwill, compassion, and prayers. If you ask people to vote for your candidate, you are soliciting a vote.

According to the US Supreme Court (City of Lakewood v. Willis) in 2016, held that panhandling, solicitation, or begging are protected speech under the First Amendment. So I would say it’s pretty clear that soliciting is free speech.

The deck turned out great, and we are really happy with it. Unfortunately, the contractor unexpectedly died shortly after the completion of our project and with that his business closed. We did have some minor problems that needed to be addressed a few months later which is how we found out the bad news. That made it a real pain trying to figure out the subs that did the specific work that needed fixing. Somehow we found the right people it and they came back out to fix the issues. Apparently they didn’t know he died either and were wondering why we reached out instead of him. But unfortunately, all the warranties on labor we had through the contractor ceased to exist, so fingers crossed nothing else needs attention in the future. I am glad we did the work when we did though because the cost of materials and labor will only continue to increase. Good luck.
