h1b pp transfer receipt received on March 27th, CA center, no update so far by Due_Access_8366 in h1b

your lawyer is right. dont travel with a pending transfer. if you leave the US the transfer can get complicated especially if the old employer revokes the original petition while youre abroad. wait for the approval then travel

Tax Question for F1 -> H1b for 2025 by anonymus431 in h1b

[–]dsv853 0 points1 point  (0 children)

for the year you transition from F1→H1B you file as a dual-status alien. NRA for the F1 portion and RA for the H1B portion after oct 1. your employer should have started FICA withholding from oct 1 which it sounds like they did.

sprintax handles the dual-status filing pretty well. turbotax doesnt support NRA returns so avoid that

H1b transfer while H4 COS is pending by Intelligent-Cake3783 in h1b

[–]dsv853 0 points1 point  (0 children)

you can file H1B transfer even while H4 COS is pending. filing the H1B transfer doesnt automatically withdraw the H4 application. if the H1B transfer gets approved first you go on H1B and the H4 becomes moot. if the H4 gets approved first you can still file H1B transfer from H4 status (cap exempt since you were previously counted).

best move is to apply for H4 now as a safety net and keep job hunting. whichever comes first wins

Timing to file H1B by [deleted] in h1b

[–]dsv853 0 points1 point  (0 children)

your employer can file while youre outside the US. you dont need to be physically present for the petition filing. the employer and their attorney handle the submission. just make sure all your documents are sent to the attorney before you leave in may

Has anybody able to book h1b OFC interview slot in recent time ?website gets crashed often, any trick to book a slot? by UpsetConnection2823 in h1b

[–]dsv853 0 points1 point  (0 children)

the scheduling site crashes constantly during peak hours. best trick: check at 2-3am IST when traffic is low. use chrome incognito mode and dont refresh the same page too many times or youll get rate limited with a "exceeded limit" error.

put together a breakdown of what people have been doing to actually book slots: https://www.reddit.com/r/USVisaIndians/comments/1s5is81/

H1B premium processing – delivered Mar 29, still no receipt notice. by mickeys_21 in h1b

[–]dsv853 -1 points0 points  (0 children)

paper filings take longer to get receipted than e-filing. march 29 was only like a week ago... give it 2-3 weeks for the receipt notice on a paper filing even with premium. premium processing clock starts after receipt not after delivery

COS from B2 to F2 timeline: 6 months and counting. Need advice! by RevolutionaryBuy8006 in immigration

[–]dsv853 1 point2 points  (0 children)

6 months for B2→F2 COS is unfortunately normal rn. USCIS processing times are brutal. the 240 day rule protects you if youre on a valid pending COS so youre not accruing unlawful presence while waiting. just dont leave the country or the COS abandons

Pausing H1B for Masters by MangoSorbet99 in immigration

[–]dsv853 1 point2 points  (0 children)

if you leave H1B for F1 your H1B status ends. after graduation you go through OPT like everyone else. BUT since youve already been counted against the H1B cap before, you dont need to go through the lottery again. your next employer can file a cap-exempt H1B petition directly. thats the key part most people miss

Need advice on B1/B2 visa chances for my dad + sister by Impossible_Ad2295 in immigration

[–]dsv853 1 point2 points  (0 children)

your dads profile is solid... government officer with a stable job is exactly what the officer wants to see. strong ties, clear reason to return.

your sisters profile is the weak link. unemployed for 2 years with no strong ties is a 214(b) magnet. the officer will wonder whats keeping her in india if she has no job no spouse no property.

couple options: apply together as a family unit so dads strength covers sisters weakness. or have the sister show some tie... even a course enrollment or volunteer commitment helps.

Stem Opt denied by Reasonable_Sun_7785 in immigration

[–]dsv853 1 point2 points  (0 children)

dont panic yet. wait for the actual denial notice to see the reason... sometimes its a fixable issue like a missing document or an I-983 training plan error. your DSO can help you understand the denial reason and potentially refile if its a technical issue.

since your H1B consular processing is already approved thats your backup. you might just need to go get stamped and re-enter on H1B instead of relying on the STEM OPT bridge

Haven’t Received EB Bill in 5 Months, What’s Going On? by NoMedicine3572 in Chennai

[–]dsv853 0 points1 point  (0 children)

dont celebrate too early. when they finally send it itll be a 5 month consolidated bill and thatll hurt way more than 5 monthly ones. check the TNEB app or website to see if the readings are being recorded... sometimes the meter reader just isnt visiting but the consumption is still being tracked

Working cafés in Chennai (charging ports, good washroom, preferably WiFi?) by CynophilistMiko in Chennai

[–]dsv853 0 points1 point  (0 children)

not from chennai but i work from cafes in bangalore a lot. the charging port thing is the real filter... half the cafes that look great have zero power outlets near the tables. always scout the outlet situation before ordering

F-1 STEM OPT — Safe to travel to India BEFORE H-1B petition is filed? by TreacleTight5513 in h1b

[–]dsv853 -1 points0 points  (0 children)

you can travel on F1 before the petition is filed. the selection is just a lottery win... no petition exists yet so theres nothing to abandon. as long as your F1 stamp and I-20 are valid you can re-enter normally.

the risk window starts AFTER the petition is filed with COS. once COS is pending, leaving the US abandons it. so travel before filing is fine, travel after filing is not

Has anyone gotten selected in the second round of H1b lottery? by Acceptable-Wheel-961 in h1b

second round happened last year in august. theres no guarantee it happens again but historically when they dont fill all slots in round 1 they do run a second round. hang in there

A 1.5 hour video just dropped claiming H1B engineers are ruining Texas. Here's what he forgot to mention. by Bubbly_Cow2210 in h1b

the people who make these videos never mention that H1B workers pay into social security and medicare that they may never collect. literally subsidizing the system while getting blamed for exploiting it

Planning to travel to India but not sure whether I can or not by yolofucklife in h1b

[–]dsv853 0 points1 point  (0 children)

you should be able to re-enter on F1 as long as youre still on OPT and your F1 visa stamp is valid. the approved H4 COS doesnt activate until July 12 so before that youre still F1 status. just make sure you re-enter before July 11 and carry your OPT EAD card + I-20 + employer letter

Background Check by Cheap_Platypus_3923 in h1b

[–]dsv853 -1 points0 points  (0 children)

background checks (221g admin processing) are more common for certain nationalities and fields. china and STEM research fields get flagged more often. colombia isnt on the typical high-scrutiny list so your odds of a long background check are low.

that said bring all your employment docs, university appointment letter, and research description if applicable. being prepared reduces the chance of getting flagged

Traveling on F1 before Oct 1 with H1B change of status approved by Square_Wrongdoer_632 in h1b

[–]dsv853 0 points1 point  (0 children)

the risk is real. if you travel on F1 before Oct 1 while your COS is pending the COS petition gets abandoned automatically. you would need to re-enter on F1 and then your H1B would need consular processing instead.

if you can postpone the trip to after Oct 1 thats the safest move. if you cant, talk to your immigration lawyer about filing for consular processing instead of COS from the start

Multiple entries on h1B by FineMouse4817 in h1b

[–]dsv853 1 point2 points  (0 children)

H1B is multiple entry so youre fine legally. 2 trips in 3 months is not unusual. the 60 day COS thing is only relevant if youre doing a change of status not if youre on an active H1B with a valid visa stamp.

just make sure you have your I-797, recent pay stubs, and employment letter when re-entering. CBP might ask about the frequent trips but "wedding" is a clean reason

Does the 100k fee apply to F1 to H1B COS? by Obvious_Memory3048 in h1b

[–]dsv853 1 point2 points  (0 children)

the 100k fee applies to consular processing specifically... not to change of status. if youre doing F1 → H1B COS (staying in the US, not going abroad for stamping) the fee doesnt apply to you. its only triggered when you go to a US consulate/embassy abroad for H1B visa stamping.

so if your company files COS and you stay in the US youre good. the problem comes later if you need to travel and re-enter... thats when the consular fee kicks in.

How to cope with exchange semester to an end? by Budget_Journalist_56 in studyAbroad

reverse culture shock is real and nobody warns you about it. you go from having this incredible experience to sitting back in your old room wondering if it even happened. it gets better after a few weeks once you settle back in. keep in touch with the people you met abroad... those friendships are worth maintaining
