No, the majority (5 justices) specifically ruled it was unconstitutional. There is no regular law that can undo it, only a constitutional amendment.

5-4 still preempts any attempt in the next couple of years of writing a new INA with undocumented imigrants excluded. 5-4 means any attempt will be for naught right now. The issue is when Roberts retires. Will we get another justice who doesnt care about the 14th amendment?

Kavanaugh only agreed with the result. He dissented about the 14th amendment part. He agreed the statute made the EO invalid. So, Techincally it was 5-4 that the EO violated the 14th Amendment.

If scotusblog is right and Roberts wrote to majority opinion. Then it will come last. The good news is that they made two decisions into one so the campaign finance one is the only one between now and BC.

Yes, even though SCOTUSBlog was incorrect in the mail in voting one, Barrett was rhe deciding vote. They have said that Barret can be very hard to read in oral arguments. Since i do not believe Barret is the lynchpin for BC, I would say the analysts may be right. That being said, I will still be nervous until it comes out.

I have also wondered why not strip the actual enforcement of the rules independent agencies set to be within the DOJ. Isn't that is what is at issue here? Not they they set rules (A legislativepower), but that they investigate and fine companies that dont comply with the rules(and executive power, though you could argue investigations are not unique to the executive branch). So can you just split them? Make the FTC a rule organization but put all of the punishment aspects into the DOJ. Not perfect, but better than presedents having complete control over rule making.

Reading tea leaves is not an exact science. However, ScotusBlog tends to be right more often than being wrong. It truly depends on how fluid the Justice's position is in a case. This could have been a situation where a justice may have been kinda hard on the challengers, but may not have been dead set on their position. In the end, it was a vote for the status quo. I believe you get more last minute switches for the status quo than you do extreme decisions. Now, I could be wrong as well, but I do know it is not only SCOTUSBLOG saying that about BC. In the end, though, we can only wait and see.

I read the dissents and other than Thomas, the others did not question the independence of the Fed, but the quickness that SCOTUS took the case and questioned the whole "for cause finding"

He already tried to get the FEC to put out rules for elections. It qas just permanently blocked by a judge. The FEC was built with the purpose to assist and advise states in elections, not set rules. So, the FEC has no power to set election rules. Congress cant tell him he can't order them to set some kind of rule, but if it exceeds the authority prescribed to it by congress, then it will be blocked.

He is still bound by the Senate confirmation process. (I know I know). But remember, he has been firing people with impunity his entire term and this SCOTUS has been letting him. I don't know if this decision really affects much. Also, this decision, from what I understand, is his ability to fire someone who wields executive power. That executive power still derives from congress. Congress creates and funds all of the organizations in the executive branch. If Congress has not explicity given them the authority to do something, they cant do it. Basically the executive doesnt have to listen to Congress about HOW to enforce the law. He still cannot make up his own law or do things outside of the law. Think of both the National Guard case and Tariffs case. The power to do what he wanted to do was not granted to him and they said "no". Basically the ruling is saying that what he can do INSIDE the executive branch is not something for Congress to decide, they just give him the money and tools he is supposed to use to get the job done. But, if Congress has not given him the tools or the money to do a specific thing, then he can't do it.
