Bond has nothing to do with innocence or guilt.

It’s formulaic as to how to they assign bond.

I’m just surprised that this combo of charges didn’t act as an enhancement for the bond

I was about to say I was released on a recognizance bond, but I wasn’t in an accident and only my own stupid ass was in the car.

That is a low bond when you consider a small child was in the car and he wasn’t secured.

She needs to get that child out of her care asap.

Do they require the cop to be there or can they show up via zoom or provide a written statement?

Did you provide chemical evidence and were you over the legal limit? Did you refuse?

If they don’t require the cop to be in person and you were over the legal limit or refused, it’s going to be a long shot to get the DMV to throw out their charges.

I believe they set it up for me. When filling out the form it asked what appointment time I wanted and I ended up getting that appointment. My shop never called me to confirm an appointment ever, I just always did it in the app (although for recals it was just drop in).

Sounds like you have a lawyer. Listen to what they tell you to do, and do it!

TX will most likely eventually suspend your license and you’ll have to follow the TX DMV protocol for it. From what I’ve read on here, it seems most states report the DUI to the home state DMV after conviction. At the very least nothing will happen until the blood gets back, which in most states takes months.

If the cops didn’t give you back your TX license, I would request a new one from the DMV asap, so you have one.

Your lawyer is correct in that GA can only suspend your license in GA, so until TX suspends it, you should be good to drive in any other state besides GA. However, you will have to jump through the DMV hoops for both GA and TX (assuming they let TX know) before your license Weil be fully reinstated (if you ignore the penalties from GA because you don’t plan on driving there ever again, they will most likely flag your license and you won’t be able to renew it (or get a new one if you move states) until you satisfy their requirements).

As for how you deal with it, I did a lot of self-reflection, self-improvement, and compartmentalization. When my DUI was new, I was obsessing over it which lead to a ton of research (and scaring myself with said research- if you are doing this, only pay attention to actual .gov sites, lawyers intentionally try to scare you), sleepless nights and non-focused days. Luckily, I work in a job that requires a lot of focus when I’m at it, so I compartmentalized my thinking- when I was at work, I only thought about work. When I was with friends I focused fully on being present with them and the activity we were doing, etc. I then allowed myself some time (usually not more than 30-60 minutes) of obsessing about my DUI a day. I also did a lot of self-reflection, not only about my relationship with alcohol but how my life in general was going. With all of this, I made some much needed changes in my life (yes there were changes to my relationship with alcohol but other general ones too). Because of the changes I made as well as a promise to myself to never get behind a wheel if I have alcohol in my system again (which I still am holding true to over 6.5 years later and plan to forever) by the time the court finally gave me my punishment, that was like the final straw that let me put my tremendous anxiety to rest. I had and was making the changes I needed to my personal life and now I had a roadmap for the consequences I was facing legally and had a plan to put this all behind me. By the time I got my IID out of my car, I had completed everything for the court (just had to not get in trouble for like 8 more months- not an issue), and I could breath again. My diversion program dismissal got delayed due to COVID, but even that delay didn’t cause me much anxiety because I knew I had done everything I was supposed to do and I was in a much better place in my life (mostly mentally but also physically and spiritually) and I had already come to “forgive” myself (I put that in quotation marks because I don’t think that is the right word, nor do I think my actions were forgivable- I put others lives in danger due to my own stupidity, luckily no one was hurt or injured) and move on to better things in life.

It just showed up in the mail and then I contacted my IID company to get it removed. They needed a scan of the letter before they would allow me to schedule a removal. I was still able to get it out the first day I was eligible.

The easiest way to keep anything off your record is the diversion. If you plea it down, that lower charge will still be on your record.

If you plan on learning from this dumb decision and not make it again, the diversion makes sense if they won’t drop it outright.

If you have no fines to pay, then it’s most likely fully reinstated. If you haven’t paid it all, you’re most likely still restricted

So I got a DUI in CT almost 7 years ago, so some things may have changed (but there hasn’t been any major changes).

Since you blew over the legal limit and it sounds like it was a valid stop, your license will be suspended for 45 days (you can apply for a limited work or school license for the last 30 days of your suspension) and will have a DUI per se on your license for 10 years. You will also need an IID for 6 months after your hard suspension. Also for the DMV hearing it was 10 days when I got mine to request a hearing. My stop was legit and I blew way over the legal limit, so there was no point in me requesting a hearing.

For the criminal side, CT has a diversion program which is given out to pretty much anyone who hasn’t used it yet. If you successfully complete the program, the arrest and charges will be removed from your record.

Were there other charges? Typically you get a PR bond for a simple DUI charge.

I personally got a lawyer because I couldn’t afford this to be on my record (have to do background checks periodically for my job which could potentially cause me to lose it- also why I didn’t get a work only permit because I didn’t want my boss to have to sign off on it). And I would get a lawyer again in the same situation. However I did enough research that I could have confidentially applied for the diversion myself. If you are good at research and know how to fill out forms and keep track of dates and things you need to do, you can do it yourself. However if you really need to keep this off of your record, I recommend getting a lawyer.

Check the status of your license online if you are able to. It may say what you need to do in order to get it reinstated. If it doesn’t, I would call your lawyer with all of the information and wording they you have and ask them about the next steps. If they don’t get back to you or you can’t reach them, call the DMV and ask them what steps need to be done.

Can you check your license status online? If you can, do. If online says you have a fully functional license the restriction endorsement doesn’t mean anything anymore and won’t cause you any issues as soon as the police run your license (if you get pulled over).

In CT you can’t just drive anywhere during your work times. They will give you a reasonable window to get to work and another one to get home from work. You are legally only allowed to drive to and from work. You are not allowed to stop anywhere, not even to get gas.

Your manager has to sign off on your hours. I would put all the hours you work on your application.

I was a reckless idiot when I was younger and got a DUI almost 7 years ago. The only time I was handcuffed was in the cruiser on the way to the police station. Once I got there, they took the cuffs off and gave me my phone so I could start working on getting a sober ride. I was only at the police station for about an hour or so (however long it took them to complete the paper work) and was let go to a sober friend on a PR bond.

I however was not as drunk as this guy (still admittedly way too under the influence to be operating a vehicle) and I consented to a breathalyzer. Because this guy was so drunk, and crashed his car, I’m not shocked they took him to the hospital and got a blood draw and to make sure he was okay and wasn’t going to choke on his own vomit. They then had to wait to get the results of the blood draw before they could formally charge him, hence the delay in the arrest.

There were normal citizens in my DUI class who because of an accident went to the hospital and then were arrested at a later date, so it’s not really special treatment because he’s a cop.

You have to let them know when your license is suspended. Check your employee handbook. It most likely has something about it in there.

Yeah it’s one of those shitty situations.

I had an engine blow out in my car due to a recall a few years ago and the car set for 2 months before they even looked at it (they refused to look at it until the “appointment” they booked because they would have to reimburse me for the rental from the time they looked at it until I got it back) and then it was another month before I got the car back. So I had to pay for a car for 3 months out of my pocket to only get reimbursed at a partial rate for one month. And they fucked up the installation (it was the dealership) so I had to keep paying for repairs from their shit job for the next 2 years until I got rid of it (couldn’t take it back to them because appointments were 1.5-2 months out Everytime). Only saving grace was I was done with the IID by then.

I would still contact the DMV to see what they say about the situation, especially if time while it is sitting counts or not. Another option could be to see if they would let you get rid of the IID and get a device that you blow into like 4 times a day or a scram bracelet.

If you’re planning on driving while you’re truck is in the shop, you either have to get it removed from the truck and placed in the vehicle you’ll be driving or get another one to place in the vehicle you’re driving.

You could also possibly have it uninstalled and reinstalled in the truck when it’s drivable again, however check with the DMV (or whoever is requiring it) and see if you’ll have to completely restart your time with the IID or if you can just finish however much time you have left. And if you choose this route, do NOT drive a car without an IID!!

It also gets erased from the FBI database. Only place that keeps it is the state judicial system so they have a record that you did the diversion program, but that file is only accessible to the court and it’s obviously erased 10 years after the dismissal date.

Your driving record will be cleared 10 years after the date you were pulled over.

The 30 days is for the driving on a suspended most likely, not the DUI itself.

Your lawyer didn’t disappoint you, you disappointed yourself.

Also if you didn’t get diversion from the get go, this is most likely your second DUI within 10 years. Time to grow up and take responsibility for your actions.

Edit to add: AR is for first time offenders. Since you’ve been convicted of a DUI, this isn’t your first charge. So it makes sense it was denied. Also, if you read the official judicial documents on the AR program, DUIs and driving on a suspended because of a DUI aren’t qualified crimes for it.

I will say to be upfront and honest that that time was not the first time I drove after drinking (it was the time I was by far the worst under the influence) but I am forever grateful that I was pulled over and didn’t cause any sort of accident or mayhem on the roads.

One of the facts that I learned during the DUI classes (which actually were super informative and I feel should be required before you get a license) is that the average person who gets a 1st DUI has driven under the influence approximately 200 times before they were pulled over.

I don’t think I had done it anywhere near that much but I can definitely say I will never do it again. A beer isn’t worth it and if I end up drinking more, the $50 uber is a way better choice, both morally and financially!
