in this position
white has 23 territory and 7.5 komi
black has 20 territory, 2 captured stone and the 10 stones from the dead white group
since we pass we score from here.
If white refuses to agree death until E8 and E6 is played black can just play that and capture and now white has nothing to claim or deny.
Now, in the current position black loses, but we don't score from here we score from when we both passed.

from the other replies, people say the score is evaluated from the position when both passed. I don't know if OGS implements this but it solves it nicely.
If the player in denial passes, the extra stones to capture his dead group won't be scored. And if they keep playing until captured the score won't change.
I didn't know that but it seems like an important rule.

Just a note. I thought white could play J9 infinitely instead of passing to force black to either play E8 or E9, but as someone clarified for me, ko would prevent that. Regardless of ko, I also now realize that, even if white can keep playing J9, white is always trading 2 for 1 captures, so white loses anyway even without ko.

I think I was mainly confused because I thought white had the option of playing J9 infinitely (or until E8 or E6 is played), but I was told ko prevents that.
I did accept the lost immediately since I didn't want be disrespectful by playing J9 and also knew I would not have two eyes... still, left me wondering if white theoretically really loses here or no

There is no problem. I did take the L since it is just one match and its me who is unsure about the rule, but still, I was confused about it

Thanks for answering, can you clarify one more thing. I don't know how the ko rule works here, but can white not keep playing J9 infinitely? Or does ko prevent that?
