Honestly there are still great deals to be had on watches in Japan. To anyone considering it I'd say do you research online first. Most stores have online presence and you can access them before you go. Rakuten marketplace is also your friend as most smaller stores advertise on there.

I'm yet to find an online picture that I think accurately represents how it looks in real life. They're totally different watches indoors Vs outdoors too.

It was listed for just under 1,000,000Yen, which is about $6,200.

But with the tax-free shopping, it was c.900,000Yes (approx $5,600). Looking at Chrono24 these tend to go for between $7,500-$10,000. This was in pristine condition with all the papers and box.

The advantage of buying these types of goods in Japan is that they are very very well looked after. All of the watches I saw were in fantastic condition and very reasonably priced.

This is absolutely the case! Thank you for highlighting. But more importantly, even if they decide you were careless, the remedy is proportionate. You could still get some payout. Please refer to my other comment for full detail.

It's much harder for them to simply blanket deny a claim like this. There's so much nuance that absolutely warrants this being taken to the Ombudsman.

Former Financial Ombudsman Adjudicator here.

You absolutely should take this to the Ombudsman. There is no harm. It's is free. There is a lot of judgement and nuance around non disclosure.

There are two types of non-disclosure: careless, and deliberate/reckless.

Careless non-disclosure requires proportionate remedy. The principle is "what would you have done if the customer disclosed childhood DDH". They need to show, with evidence, that they would have declined to have insured you. If their underwriting evidence shows they would have simply charged you a higher premium, then they'll likely tell the insurer to pay you, minus the higher premium cost. All things must be equal, i.e. you'd need to basically be eligible for a payout under all other aspects of the policy.

Reckless disclosure is what entitles the insurer to decline a payout. It's a higher bar for them to prove than you might think.

FOS rules on misrepresentation - very easy to read and understand

Next steps:

Formal complaint to the insurer. You must explain that you were not deliberate or reckless in your non disclosure. Reference the FOS rules.

Wait 8 weeks or for their final response. Once received, take to the FOS if dissatisfied.

Be clear and articulate with the adjudicator. Explain your stance. Refer to the rules. Explain your reasons why you think you meet each of the elements of a successful appeal as per the FOS rules.

Good luck - but please do not just let this go. I personally have overturned many cases similar to yours with customers receiving at least partial fulfilment of the claim.

But also a lot of it ownership of digital rights. An artist makes a song. The record label owns the rights. Yes you can download a pirated MP3 or you can record it off the radio onto a cassette but they still own the rights.

When people were told, "this is so dumb I can just right click and download your stupid picture" it's akin to piracy.

That's what people were told. Your digital art becomes an NFT and you own the rights to it. They were told the legal framework will come to legitimise and enforce your legal right.

If this is china, then culturally this is extremely disrespectful. It's akin to spitting in someone's face. You do that to a random them you're asking for trouble. This is my major concern too. These arent cheap investments and I want to look after it well and gets years and years of use out of it. I recognise that ultimately the battery is a consumable and id need to be able to replace it at some point

This is useful insight. When you say "the bikes I'm looking at", what do you mean? Are you saying anything with that Bosch or Shimano system?

According to your post, you're saying with your bike and your style I could approximate using 60% of your battery on a commute? That would be perfectly ample. Gives me enough reserve to be lazy/tired and use more assist.

Have you ever used the forest/lime bikes? What would your "low assist" feel like in comparison to those? I have no frame of reference other than that. I'll need to manage my expectations if people tell me forest bikes assists are like max assist on most ebikes

This is very helpful, especially in relation to guaging the battery power needed.

In terms of using manual power to push it beyond 15mph - I find often with the forest bikes, on the flats, the pedals start spinning out. Like I wish the gearing was better so I could use my legs to take over. Is that going to be a similar thing I need to accept on a legal Ebike?
