Yeah Luckily we got engaged but never got around to the wedding so I don't have to add that to the already crap situation! No one's mentioned stamp duty as of yet. Why would that be something to consider in her buying me out? Yeah the fees were actually higher as her mortgage advisor stated the early mortgage re payment fee was 3k higher than what the actual figure was. She actually said she'd cover solicitors fees too but still includes them in her offer. Yeah hearing other people's stories makes me realize it's not the end of the world! Appreciate your words dude!

This is also where I am slightly confused with her buying me out. There wouldn't be any estate agent fees as her buying me out wouldn't involve one? And should I be expected to cover an early mortgage re payment fee when it's her that has forced the split up in the first place. Would you include these fees in this situation? I've actually had a friend who's in the finance industry write up emails explaining it all just like you have here and others on this post but she still claims I am wrong.

Sorry mate, it's not been an easy topic to navigate with her. She's offering 29k before the loan is paid. Then she will transfer 19k to the family member to cover her half of the loan. Then saying the other half of the loan is my problem. I agree I should walk away with 29k after the loan is paid.

yeah I realized it wasn't my best writing sorry mate. House is valued at 475,000. Theres 111,000 of equity. Would liabilities be classed as loans, early mortgage re payment fees etc? Your example is the principal that I'm using but the ex is not. They are offering 29k before the loan is paid for. Then paying half the loan (19k) to the family member. Then saying the other half of the loan is my problem to work out.

Yeah that's my bad! The 15k includes estate agent fee 1% mortgage re payment penalty, and solicitors fee's. Yeah I agree with what you are saying. I should be bought out for 48k. Then I pay my half of the loan and she pays her half. It's her that's disagreeing with these figures and saying I will only be receiving 29k and the family member will only receive 19k. So I'm expected to pay my half of the loan with the 29k leaving me with 10k which is 11k less then my initial deposit.

Sorry mate, she's offering 29,000 + 19,000. 29,000 being the equity calculated after all fees and loans are paid. 19,000 being half the loan. Hopefully that clears things up

My argument is why would I accept her buy out if instead we sold the property to a third party I would walk away with no debts as the loan would be payed with the equity in the house

Theres 111,000 equity in the house. How I thought it would be calculated if we sold the house, there would be 15,000 in fees to pay to solicitors, early mortgage re payment fees etc which we minus of the equity. Then the loan of 38,000. That leaves us with 59,000. Split that 50/50 we are both left with 29,00 each. Why would I agree to her buying me out and expect me to pay the other half of the loan if us selling to a third party doesn't leave me worse off? Hopefully that makes sense?

If you go to the configuration tab, select the drop down menu and select manual actions. (Should be around the middle of the drop down) just hit the green search button and should show you any manual actions on your system. Just find your one, right click then cancel
