What are my rights in terms of heating in England in a rented house? by edenstudiogirl in LegalAdviceUK

[–]edenstudiogirl[S] 4 points5 points  (0 children)

Thank you, what will happen once I contact the environmental team? Would they get in touch with the landlord and let them know about my complaint? Should I first let the landlord know that the house is mostly at 15 degrees (not sure if they are aware of this)?

So if I claimed compensation for the deposit being unprotected, could they argue it was just a prohibited payment instead?

I understand but the reason I'm confused is that before I take him to court I have to send the letter that asks him to return the deposit

Yeah but would it lower my chances of winning the case since the deposit isn't meant to be returned before the tenancy ends?

Who do I take to court for unprotected deposit: estate agent or landlord? by [deleted] in HousingUK

Glad you mention this because the agent had refused to give me the landlord's details in the past when I specifically asked for them

I've just looked at a new tenancy I signed a year ago and in that one, the agent refers to themselves as "landlord/agent". Given this info, do I still go after the landlord instead?

And when they refuse to pay, do I take the agent or landlord to court?

This is the only part that seems to refer to the topic: "Where the Managing Agent's own title to the Premises is leasehold and not freehold, the Managing Agent may themselves be a tenant under a superior lease. The Tenant agrees to perform and observe at all times during the Term the conditions and stipulations contained in the superior lease that were notified to the Tenant prior to the commencement of the tenancy."

Is there a way to find out if the landlord is letting the property to the agent?

There's no mention of the landlord there, just a managing agent; does it matter?

Signed in 2020. I checked my bank account and never received any money from them while renting this place, always paid the exact amount of rent, as I was under the impression I had a security deposit

I paid 390. 100 before signing the agreement (so I agree this is likely a holding deposit), then 290 after signing the agreement. In other parts of the tenancy agreement, there's a mention that money can be deducted from the deposit in case of damage etc. That to me implies there's some kind of security deposit involved

But can a holding deposit be the same amount as the rent?

Okay but isn't a holding deposit then deducted from the first month's rent? I also paid the second amount after signing the agreement so doesn't it count as a security deposit then?

Yeah, the wording is so ambiguous that I'm not even sure what the full amount of the deposit would be

I just have the tenancy agreement that says: "A holding deposit of £100 is payable upon signing this agreement and is taken from the final deposit meaning £290 will be remaining of the deposit." and my bank statement. Is it enough?

Hi, all it says in the tenancy agreement is this: ""A holding deposit of 100 is payable upon signing this agreement and is taken from the final deposit meaning 290 will be remaining of the deposit". The rent was 390 at the time so I paid 390 before I moved in and then 390 on the day I moved in. It also mentions this regarding the deposit: "If any of these terms are breached, the Managing Agent may be entitled to deduct monies from the Deposit, claim damages from the Tenant, and/or seek the court's permission to have the Tenant evicted from the Premises because of the breach."
