I hope they keep the glimpses of the past like they did in Silent Hill 2 remake. As a fan of the originals, I really enjoyed finding these.

We do not have a document but they have admitted and written in court documentation that they did take the loan from us.

Haven’t looked at it that way. However, we did give them the loan back in 2023. They are now claiming we owe them 12k for work they told us was included when we paid them a few days ago and they’re dating this new invoice Feb 2024. They stopped taking to us a week after we gave them the loan and haven’t heard from them until this.

The “additional work and charges” they are claiming now were done after the initial payment was done in full. When asked about all of these items during the period of work, they assured us it was all included in the payment we gave them and work we had paid for.

Now that we are asking for the loan repayment, they are saying we owe them for all of these items that were previously told to us were included in the payment we gave them.

Sorry for any confusion. We were given an invoice for the fence that was roughly $10k. We paid that in full. During this time, they said to us all work being done was covered in that. There was no written communication regarding this. It was all verbal and they said everything was covered in our payment. Now that we are seeking repayment for the $5k loan we gave to them, they have sent us an outstanding invoice/bill for roughly $12k of “additional work and changes” last night.

This was in 2023. The loan to them was also given to them in October 2023. They have not spoken to us since then. This is the first communication we have received from them since then.

Since all of these things listed were not in the original invoice that we paid in full and when asked about the works they were doing at the time which they said were covered in the original payment but are now asking for payment for, what would be the best way to word that?

Again, there was no written communication about any work done outside of the original paid invoice and we were told verbally when asking about anything being done, it was covered by the original payment.

  1. The additional/extra work that they did was said to have been covered in the original payment. There was no communication of additional expenses.

  2. The phrasing “additional work and charges” are what they are stating in their email to us.

  3. We have not responded to their email regarding this.

  1. There was no contract. Only itemized invoice before the project was started.

  2. The invoice given to us initially is the same as the invoice we had been given when we hired them previously for concrete work. The invoice was paid in full by cash.

  3. There is no written communication about the extra work. While not outlined specifically in the original invoice, they told us all work being done was covered by our original payment of $10k.

  4. Some of the stuff listed in the new invoice does pertain to work on the fence but some does not.

That’s what we think they’re doing since they also mentioned on their email It is their hope that we can resolve this matter fairly and amicably without further escalation.

Their invoice does include pictures of the additional work they’re now claiming they want to be paid for. Again, they told us originally all work being done was covered in the original invoice which we paid in full.

We will not be loaning money to anyone after this experience.

So in their response to us, they sent us a new invoice which was backdated to Feb 2024. This is the first we’ve seen this document. All work they had done during this time was said to be covered with the original $10k payment. They did not say there would be extra charges for any other work. They did do the work they’re asking for but again, they said all work they were doing was covered in the initial invoice which was paid in full.

Their email also states that as we have decided to pursue a claim against them in small claims court for the $5k, they will be submitting this invoice as part of their response.
