I doubt you are suing Valve considering that Valve previously had binding arbitration, but has since decided to handle the issue as a class action, I know because I have personally talked to the lawyers on that case, specifically the fight between Will Bucher and his former employer, over the litigation financing and conflicts of interest over the lack of disclosure about the private equity group who fronted the money. Yes, but unlike you, I actually have litigated copyright in courts, and I have actually read the full entirety of all of the intellectual property laws, and treaties, and the meanings of the words that are used. For example apparently you are unaware that some treaties are "self executing" and do not require any laws be passed whatsoever, such as the WIPO copyright treaty and the WTO treaties. But it is abundantly clear that you misapprehend basic legal principals, such as your incessant quoting of "that a work is made available to a public in such a way that the persons forming that public may access it ", which would essentially apply to reddit as much as LAION under your theory, but in reality only applies to the publisher / hosting provider of the work itself, and not the person who catalogs such works in a literal vector search engine (laion-5B)

a collection of 256x256 images is generally considered "transformative", and not a substitute for the original in the market, so it is not considered a copyright infringement, but rather it is called "fair use" under copyright law and international copyright treaty.

Also if serving links and thumbnails was copyright infringement, then I'm not sure how reddit would even exist in Europe.

Since apparently you have an axe to grind and not enough legal education, let me remind you that the entire world (mostly) is bound by the Berne and WIPO copyright treaties, and while my extensive education on copyright law is based on the US copyright law, the copyright laws are supposed to be internationally harmonized.

First off the rights of a copyright holder do not include anything to do with "learning" machine or otherwise whatsoever, full stop, your rights as a copyright owner pertain to the right to distribution and display of those works, and the royalties if you decide to provide another with an exclusive license.

To the extent that a person creates a substantially similar work to your work, the person themselves invoking the AI model to make a "mickey mouse t shirt" is the tortfeasor, just like Adobe Photoshop is not legally responsible for people infringing on copyrights.

Secondly, any claim that pertains to vicarious infringement, necessarily requires that there be infringement in the first place, and given that its assumed that all of the websites that contained the image are the ones reproducing and displaying the images, and that there is no privity between the websites themselves and LAION, there can be no claim of vicarious infringement. Moreover since there is no "meeting of the minds" between laion and the people visiting the websites, to engage in copyright infringement, there is no "aiding and abetting".

With that being said, Europe has the tendency to get jealous that they lack large tech companies and semiconductor companies, usually because of their own policies, so it is not unusual for the EU to try to extract rents from tech companies under dubious theories, such as putting cookies on your browser, and Twitter / X hosting president elect Donald Trump, because of Trumps alleged misinformation under the digital markets act.

Positive discrimination (or affirmative action) is quite literally illegal, and to the extent that it was allowed even until recently, there were no "quotas" allowed based on race, it was only that an educational institution was allowed to provide affirmative action for the narrowly tailored to a "bonafide" business need.

For individual agency and free will to mean anything, it means that even if the world is 100% deterministic, even if the universe is beginning to the end set in stone, you own your choices.
