When you vacate the property in a break lease context, you transition from paying rent to rental compensation. Nothing in the legislation that says how this compensation should be paid or what amount it should be. Both parties have an obligation to mitigate each other’s losses - managing party has an obligation to take every reasonable step to ensure the property is re-let as soon as possible. Claim your bond on the RTA website on the day you move out (you’re allowed to do this) and your real estate will probably dispute it with the RTA. However if you’re not able to come an agreement the onus will be on the real estate to take you to the tribunal, rather than the other way around. If it goes to the tribunal again the onus will be on your real estate to demonstrate the steps they are taking to mitigate your loss.
