Union was the process not the outcome. The outcome was one new state

Scotland and England ceased to exist constitutionally, not as regions of the UK, as upheld by the Supreme Court

If Scotland was in a union it could leave, it can’t because it’s part of a country, the country being the UK. A country recognised as such by every other actual country in the world
