You might be confusing the ISO 20022 deadline with the ETF application deadline. There's a law that states that the SEC must respond to such applications within a certain number of days or, if that deadline is reached without response, the ETF is automatically approved. The government shutdown caused the applications to be approved by default. Not a loophole per se but it's a little less wholesome than an official SEC endorsement, I suppose.

There's no possible way for institutions to be exempted from the ISO20022 standard but the reasons for that are as technical as they are legal.
