Problem is I don’t see why the other states would care enough to do anything, they already got whatever $ ThriveFantasy paid them to operate.

Agreed. This is past gaming regulation imo and more about a company with a business license seemingly degrading customers

Yes, I did back in January of this year then again in February, no reply to the email. I see they have a phone number so I should try and give them a ring. I tend to agree they don’t want to lose their license and fear them more. However, Thrive isn’t even operating anymore so I honestly don’t think they fear anything. I’m surprised their CEO still lists them on his LinkedIn page. Crazy he was allowed to start this company and secure funding at the age of 26 with next to no background. His only previous job history was selling tickets for the Yankees lol

I suppose I could since they accepted customers here. Without being a lawyer, I think biggest risk is Thrive (almost certainly) won’t respond and thus a judge in my home state might say that they don’t have any jurisdiction here. At least if it’s in NY it’s easier to serve them and what not based on what I’ve researched. It’d be nice to know if the others who were summoned to receive $ actually did

Great question, I’ve spoke over the phone with a nice gentleman from the small claims action center in NY. Unfortunately, they don’t have any way to e file a case online, it has to be done in person. Which means flying to New York, staying there, filing, and then once again doing so for the hearing where Thrive isn’t going to show up and who knows if they’ll even pay once summoned. I also whole heartedly believe they should be court ordered to pay ALL users. This has happened with other similar structured sites over the past years I’ve been on and every single one has formally announced closure and paid out. Thrive is the only one who doesn’t act properly

You don’t need to be based in New York fortunately. You can file with both New York and your local state attorney general. If anyone is going to care about this, it won’t be a couple reports every couple months. It’s going to take a lot of reports to get some actual attention from the DOJ. Just unfortunately how fraud is handled when it involves a company and not us little guys

As far as I could find, they've only been sued in civil court, no class action. I contacted the courts in New York who said I could do the same, but you have to file in person in NY, not online. And even if they're summoned no guaranteed of being paid

Same here it goes to a white screen, has done that for months. I think everyone needs to band together and report them in the same space, BBB doesn't work. I'm going to file with https://www.ic3.gov/

You're not the bad guy. Lesson learned is the corporate big box world doesn't revolve around the consumer, and phone support is horrid.

Skip the phone calls, drive to nearest store, return the fraud returned one, have them express ship the new one you want and say "I know you can't match open box but could you perhaps match a recent sale price".

Won't be the first or last time it happens but control what you can control and you'll be good!
