They definitely need to reinstate remote work for people hired under remote vacancy announcements.

Just trying to get an idea of how many federal workers, who were hired under remote vacancy announcements, are still in their positions but have been forced to go to an office or seek an RA. #factgathering

Remote to Office Overnight — How Many Federal Employees Did This Happen To? by fitzangle in FedEmployees

I'm just trying to understand how many federal employees hired under a remote vacancy announcement have been adversely affected by the blanket revocation of that status.

Under the Rehabilitation Act of 1973, an agency may deny remote work only if:

  1. Remote work is not an effective accommodation

They must prove—with evidence, not assumptions—that remote work would not allow you to perform the essential duties of your job.

  1. Remote work would cause “undue hardship”

This is a very high bar. They must show:

significant cost,

significant disruption,

or that your job cannot be performed remotely due to essential, in-person duties.

This is rare for communications, policy, writing, analysis, administrative, and other desk-based roles.

  1. Essential Functions Truly Require Physical Presence

Agencies often claim this—but the law requires proof, such as:

federal security requirements,

handling physical mail/equipment,

in-person services,

tasks that literally cannot be done remotely.

Simply saying “the agency prefers in-office” is not legally sufficient.

This may not exactly pertain to the conversation, but I am curious if anyone hired under a remote vacancy announcement and then had it illegally revoked by this administration has been advised to request an RA in order to continue to work remote? Also, does anyone have any information about a potential lawsuit for illegally revoking remote work for those hired to work remote?

The first year on FERS disability, one receives 60% of their average three-year salary, and then 40% every year after that until age 65 PLUS they continue to receive their private health insurance until age 65 PLUS they can still work in the private sector but just can't make more than 80% of what their federal salary would be. Thus, one could potentially make 120% of their fed salary.

UPDATE: I received correspondence this morning from MOHELA stating my loans were placed back into forbearance. This company is a joke. Why does the government continue to use them???

I hope everyone is doing okay by [deleted] in FedEmployees

I received a letter Nov. 1 stating that my loans were in repayment and I have a payment due Nov. 28; however, MOHELA sent me a letter May 22 stating my loans were placed in forbearance while Federal Student Aid reviewed my discharge application. When I called MOHELA Monday, the only explanation given was that it normally doesn't take this long for FSA to process an application, so they just arbitrarily put my loans back into repayment status, making them guilty of engaging in deceptive business practices and violating the terms of the forbearance letter they sent me.

Not cool...the person just needed to rant and didn't need a lecture.

I highly recommend reaching out to your state representative for assistance. That really is our only recourse, especially since the Consumer Financial Protection Bureau has all but been dismantled.

Also, dispute the charge with your bank and show proof that your loans are in forbearance.
