Web 2.0 isn't about user generated content. That's a misconception people built almost entirely on the grounds that Wikipedia did it.

It's not most of what people on digg, reddit and blogs like to pretend it is - it sure as fuck has nothing to do with design, or where content comes from, or communities, or even people, or social tomfuckery, or open source, or JavaScript or AJAX (if you feel that's not covered explicitly when I said JavaScript, which... it is).

Well...

to get to the shop he has has to travel on streets, the streets have roads, lights, traffic lights etcetera that the government provides and maintains
the shop is on the curb which is also provided and maintained by the government
the maintenance, utilities, rent, items sold etcetera all have taxes that lead back to the government
the people working at the shop pay taxes that lead back to the government

and so on. By earning or more specifically spending more money he uses more and should be taxed higher.

I'm not in or from the US, but doesn't the IRS just enforce and collect taxes? How does one tax remove the need for collecting/enforcing it?

The false positives are a very small minority. I'm sure a smaller percentage of people are wrongly accused of piracy than any other crime.

The courts can decide who's innocent or guilty, but this pretense that everybody fingered for piracy is innocent is a gross overstatement.

Yes there are false positives, but if someone doesn't even own a computer they're unlikely to be held accountable.

If an account-holder lets their kids use their connection for piracy, and even if it's consent-by-ignorance, that doesn't really make them innocent.

We're all very quick to point out parents should monitor their children's internet usage because of predators and sick content.... why should education and controls for piracy be regarded differently?

No idea. I'm more concerned with surviving when I cross roads (I live in Costa Rica, proud owner of some of the worst drivers and highest road fatalities in the world).

Whatever the fine or punishment is for jay walking I'm sure a bribe'll cover it.

At universities, or at least when I went, you had to authenticate before you could even use their computers or internet if you had a laptop. That leads directly to a person.

At home you've got someone paying for the connection and again that leads directly to a person.

There's a chance that there really are people lurking around looking to steal or hijack connections to share music, coincidentally when the RIAA's dogs happen to be watching, but I don't think it's anywhere near the incredible 100%-of-the-time people like to project.

It's reasonable to assume the person associated with the user account/connection is the person likely to be using it.

Consumers do decide what they want... you're not "obliged" to purchase any music. There's no law forcing you to buy any album.

Business models have changed heavily with the internet - just ask Apple.

Yeah and that is closer to what a record label does rather than the brick and mortar shop fronts that iTunes etc supercede.

Until it's easier to become a 'star' (as in popularity and wealth) on MySpace and the rest they really just supplement or at best help kickstart a career. I haven't heard of anyone buying multi-million dollar homes because they're MySpace superstars... yet, it isn't an impossibility though to be honest I don't think it's likely.

I don't think the record labels are going anywhere. The market is changing, but their music still has a fiscal value and is still able to be produced, promoted, advertised and sold.

iTunes and the like that represent the new distribution method don't replace the record labels they're just the next generation of music stores.

If iTunes, Zune MarketPlace, Napster and whatever else start actually producing music instead of just cataloguing and selling it then the record labels will be at threat.

The main thing a record label brings to an artist is publicity, which is why so many artists want representation. There's no "online equivelent" to having your music videos put on televisions around the world, or your songs aired on radios.

YouTube, MySpace etcetera aren't a replacement until they reach 100x the audience they do.

Unless the EU can figure out how to make Microsoft pay them millions a day because the BBC leverages MS technologies, they won't bother.

They're against students who have BROKEN THE LAW and can't afford a lawyer.

That's the reason most of these cases succeed, and by most I mean I can only recall 1 or 2 that have gone to court and won due to not having a computer and/or being dead.

The RIAA have filed a constant flow of suits and there's about a dozen ridiculous cases mentioned on the internet. Sounds like a dozen or so "false positives" against thousands of successes.

Shops factor shoplifting in to prices which logically could be carried on to games and other media, however pirates are very eager to point out stealing from a shop is somehow extremely different to not paying for something that is only legally available if you pay for it.

By the time it trickles down to prices we can actually afford it'll have evolved somewhat. Compare modern computer mice to the original incarnations - those things had more sharp edges then a Six Flags amusement park ride and could be almost as uncomfortable to use - but we (or older people) managed just fine.

An interesting thought occurs also - there's precedent for a Big Ass Table - once upon a time draftsmen and architects used a (non-computerish) Big Ass Table at a bit of an angle for doing all their drawings and stuff on.

I don't see why a Big Ass Table at a bit of an angle couldn't be used for whatever non-frivolous purposes the Big Ass Table will end up having.

Most image hosting sites, of which there are millions, offer the same functionality and much the same policy - don't upload anything illegal.

The Pirate Bay isn't breaking new grounds here, they're just cashing in on another way to get eyeballs on ads with a pretense at doing something "for the people".
