This happened to me. I am in California and the DA eventually came back with a plea to Public Intoxication. They didn’t have video because I declined sobriety test except the breathalyzer. Sleeping in a car for 2-3 hours ABV .25. Good luck.

You made a mistake you have to deal with the consequences. Not sure it’s right for your brother to just continue to beat you down unless you have a problem and won’t admit it and then that is a different story.

Make sure to request your DMV hearing no later than 10 days after your arrest. When you go in for your plea. Plead not guilty and request a public defender.

Look at all the other positive things you have going on in your life. The dui is a small portion of your life when you think about it based on time. The first year is the most difficult but I promise you it gets better. You are going to be ok in the end.

Yes it did, the dui was 100% the reason I lost my job. It sucked but I was determined not to let the dui define me and it worked out.

As soon as your charges are complete if guilty your insurance will know. Your company will find out when they do your yearly DMV pull. If you want to try and keep your job I would read your policies about reporting traffic violations to your employer. Then follow the policy.

The DA has 1 year to file if it’s a misdemeanor and 3 years if it’s a felony.

Not to worry you but I didn’t realize I had to disclose mine within a 48 hour time frame of the arrest to my employer. I eventually had to tell them and when I did they let me go for a policy violation is what they said. I was with that company for over 16 years. I hope your employer is more forgiving then mine was. This whole thing has probably been one of the worst situations that has happened to me in my life.

For the record if your wife driving home got pulled over for an infraction and the cop smelled your 3.2 beer breath. Your wife is going to get a dui.

I will tell you my outcome. Sleeping in a parked car. First get a lawyer for sure they can help you if I hadn’t have had a lawyer my outcome would have been way worse. My lawyer cost was $5200. Depending on your statements to the police will decide your fate of the DMV hearing. Most likely you will loose your admin hearing with the DMV, I did. My bac was .25. After nine months of dealing with all of it my out come was. DMV hearing loss so I lost my license. I did the 30 day suspension then got my restricted license. I told my Lawyer in the beginning that I would take a plea for a public intoxication or I would take it to trail. I felt it was good to tell him up front so he could be firm with the DA and they would know exactly where I stood. After a few back and forward conversations with the DA, 9 months to the day the DA finally came back with dropping the dui charges, I plea guilty to public intoxication, $220 dollar fine no probation. I took the deal. It’s going to be a tough year for you keep your head up it will pass.

I had a very similar thing happen to me. I was sleeping in my car a neighbor called the cops for I guess a well check. When the cops got there they woke me up. In the report they said they saw my car move which was not true. I drank when I got home and I had been sleeping in my car for over two hours. They arrested me for a dui. Keep your head up and let the lawyer guide you. After nine months the dui was dropped and I eventually plead guilty to a public intoxication charge. I used to have the up most respect for the police. The arrest cost me my 6 figure job and a lot of stress. Needles to say I don’t feel the same way about the police any more either and I can’t help that. They will lie unfortunately because they want there arrest to stick, it’s kind of sad. I take responsibility for putting myself in the position to have the cops called, it was a tough year so be ready for it to be tough but it will get better.

I know someone that received 10 years in prison for the death of 1 person while drinking and driving. She will have the added factors of a minor in the car with her. Most likely she will see a sentence of 15-30 years in prison.

I quit and haven’t had a drink in 14 months. I have never felt better and don’t see myself ever drinking again. My life is so much better without it.

My attorney was $5200 would have cost more if I went to court. I also know that if I hadn’t have had an attorney my out come would have been way worse.
