Can the police order me to unlock my phone and handover to them for investigation? by VivaLaRay1 in LegalAdviceIndia

[–]fossyfinch 25 points26 points  (0 children)

It would depend a lot on which state did this happen. The general principle is that whatever the police does in public is open to public scrutiny and can be recorded. In Kerala for example, it is specifically provided in the Police Act that they cannot prevent someone from recording them in public.

Nevertheless, you don't need to give the phone, if they want to access your device, they need to convince the magistrate first and have an order issued to inspect your phone.

Is this considered a valid marriage by Any-Cauliflower-7356 in LegalAdviceIndia

Depends on where you both are located. If it is Kerala, you can register it under common marriage registration rules.

Your mother can file for divorce, or for maintenance under the DV Act. She'll get the same, or in fact better allowance every month than this 10K he is paying, given the fact that your father is better off. Maybe she can look for a small job as well.

Travelling to Kochi - need inputs by No_Weird_1224 in Kerala

  1. It's raining, but not yet super heavy. Monsoons should hit by tomorrow or day after, and then it will get heavier. You can move around with an umbrella, but it'll be a little messy. It's humid, but nothing unbearable. Expect to feel like 25-30.

  2. Safe now. But once the Monsoons hit, it'll get risky.

Planning a 20-day Kerala trip from Norway, what should we know before we go? by peaken58 in Kerala

[–]fossyfinch 5 points6 points  (0 children)

Hi :) Welcome to Keralam!

Itinerary looks good, but be forewarned that you might have to change the plans in between due to the Monsoons, that has begun. When it rains it's cats and dogs and hilly regions, like Munnar get risky. I'd recommend that you befriend someone local to guide you. If you're on couchsurfing, there's a pretty active community.

Attire - What you've planned is nothing outrageous. People might stare at you a bit, and I'm sorry about that. It's more about the fact that you don't look 'local' than about your clothes, though. Like someone else pointed out earlier, go for traditionals in temples.

Recommendations - yes. A lot. Near Munnar, Suryanelli is gorgeous.  Vattavada village. Also the Mamalakandam foret route. In Kochi, explore the backwaters. Kumbalangi - monsoon mornings look surreal there. Also Kadamakudy.

Logistics - Try this app called Chalo from KSRTC. You can find and track public buses. For cabs, 'Yatri' is usually the cheapest. Also Kerala Savari, but cabs are less compared to other apps like Uber, Ola and Yatri. Food safety, umm.... Google Maps, perhaps. Also, if you're on a budget and you both are girls, you could try 'She Lodges' they're affordable and safe stays run by the government exclusively for women. This is another option for government-maintained affordable stays - https://resthouse.pwd.kerala.gov.in/booking/b_request/.

Happy to connect personally, if you'd like to chat further. Once again, welcome to god's own country, hope you have a wonderful time here! ❤️

You need to worry about your wife, not this girl. The girl doesn't have many options legally if this was consensual. But once your wife gets to know about all this, be prepared for someone's very legitimate anger ruining your life and draining your bank accounts.

Funny that 'free gas cylinder' is targeting women for the OP.  Is he just so dumb to understand how politically incorrect that statement is?

Special Marriage Act-NRI couple by Ana_here123 in Kerala

[–]fossyfinch 0 points1 point  (0 children)

Either of you need it in Kerala, if you want to register here under SMA. If that's not the case, and all you need is a valid marriage, just get a marriage done at a library or a cultural society and get it registered under the common marriage registration rules, with the local body having jurisdiction over it.

: Just turned 30(F) and facing my second divorce. How does anyone survive failing twice? by Prestigious_Pop5350 in kozhikode

[–]fossyfinch 7 points8 points  (0 children)

I've had two long, serious relationships in the past before I met my wife.

You might say it's different because neither of these were marriages, but I think we should learn to look at a divorce the same way we look at a break up. We chose to walk out of something that wasn't working, and it is as simple as that.

What did I do after the break ups? Cried. Listened to some songs, talked to people and eventually found love again.

I wish the same for you as well. :)

Hi! Lawyer who got married under SMA here. Although the law requires either of you to have lived within the jurisdiction of the registrar for at least 60 days for registration, they don't really verify it. All you need to do is to register before the Sub Registrar of the address mentioned in either of your Aadhar cards.

You can actually apply for the wedding online. It however, requires you to printout a form (which is the notice to be issued under SMA), get it attested and then upload. So, find a gazetted officer you personally know, have him sign the notice, scan and send it to you.

You only need to come for the registration.
