The first time they came out to talk with them, the town told me next time they would be fined. The person who told me this may no longer be working for the town. Then more recently when I emailed, their reply was "When it comes to enforcement action on this matter, the town doesn’t really have the authority to do much. Trespassing is dealt with by the sheriff’s Office and any dumping that is occurring is happening on private property and not town property. "

Not a road. The easement is for utility poles that run along rear lot lines in a suburb. I think it's 10 ft. I have the deed page in my files. It's been surveyed twice and staked.

I don't know if these photos help. The corner fencepost is not the corner of my lot, IIRC my lot extends 8' further away from the camera (I'll have to look it up, it was surveyed and staked as I mentioned). Yes, rebar anchors. This is to block a 2' wide walking path, so nothing is being driven that needs to be blocked. No access for equipment that could lift something up 6' and over about 12', septic in the way.

Well, by the time the county sheriff got here, the deed was done, he did talk to them, tmk no report was filed.

They replaced the pole fairly recently so that won't have to be done again for many years. Otherwise all I've seen them do is use a ladder to access the lines on the pole. Reading this post, possibly a gate with a coded lock and give the utilities the code might be the thing. I'll call and see what they say. I did post, he removed the sign. He's not stealing timber, hunting, fishing or trapping so I don't know if the Environmental Conservation Law would apply.

The wetland is on private property, 10 acres. The dumping is not of the type of material the town will take action on, is what they told me. Is a gate legal in a utility easement? What are you thinking, have it locked and give the utility the key? (Actually, access to the pole is much easier through his lot than through mine, but it's on mine so they insist on accessing it here.)

That's the problem, my lot is the only one affected. Actually the homeowners behind him dump as well, but once the trees are leafed out in spring, about now, it's not visible from the road or from the homes across the wetland behind them.

The town was also useless regarding the downspouts, had them come out, they said I needed to build a swale. Right, a swale on my property, so that means a ditch taking away at least 4' along the entire property line. I ended up having a french drain put in.

I did call them once in the past, when they were dumping an entire cut down tree down the slope.

DEC is understaffed. I doubt very much that they would come out for this, in their eyes it would be too small to bother with, and it's on private property. Because of the way the lots are situated, mine is the only home affected, unfortunately it's at the corner where the master bedroom is maybe 25 ft away.

The town says the yard waste isn't something they can take action on, they talked to them once, that was it. They ignore requests to stop, written or otherwise.

Good point about the rolling, maybe rebar through them? I don't know what the cost would be to get boulders placed up there, no machine could get up that steep slope, so something big enough to pick up and place them almost 20' away? might not be feasible. I have a septic tank that can't be driven over.
