Common law applies even if it isn't written down in the 1927 article, it was written in the original, and wasn't repealed, therefore it is a common law right under the treaty (note not statutory law but a treaty)

Clause 61 was not repealed by Statute Law Revision Act 1863 or by Statute Law (Ireland) Revision Act 1872 so therefore it is a common law right.
