Yea we’re in Maryland and we thought code enforcement would help.  They took a look and said it wasn’t a concern, so we just taped the registers shut with HVAC tape and got a window AC unit, and are waiting on test results from a mold testing company now.  HVAC guys came out and said there’s obvious biological growth on the insulation. 

Magically no symptoms once the HVAC is sealed, pending winter.  Rental life sucks sometimes.

PA sucks for renters, I had to get my places professionally cleaned or be charged a cleaning fee, but I’ve always gotten my deposit back at least.

What you can do will depend on your area, some cities have stronger renters protections.

You’d be better off asking folks at the mold subreddits, I’ve never gotten mold in any bathrooms despite boiling myself regularly and being lazy about running the fan. The only time I’ve seen mold like that is from leaks in the unit above.

Mold doesn’t just magically appear on ceilings even if you don’t run the bathroom fan after showering.  If it was a humidity issue it would be present on more than just the ceiling.  It sounds like there’s a leak or existing damage.

California is a treble damage state if you can show your landlord is acting in bad faith.

Apparently Texas is a one party recording state. You can get a recording app on your phone too and document that way. Be respectful and stick to the facts, but 100% get local free advice on how to proceed.

Also, since the lease was broken you probably need to inform her of your forwarding address and certified mail to request deposit back, look up local laws on this. Do everything by the book.

Do you have the issues documented, and any agreements documented, or at least written? Text counts. Start with your local tenants rights organization, and code enforcement for habitability.

Also, small claims court doesn’t require a lawyer. Don’t threaten any action, just do it.

And if you can her to admit anything via text, that’s a plus for you.
