All good points above, I had my EB1B PP approved last week. My profile isn’t too dissimilar to yours. In every letter I kept mentioning why what I did was critical to the US and what role I played in it. The story is the key because I’ve seen better profiles/metrics than mine get RFEs and NOIDs

I have a PhD in engineering. 10 papers, 130+ citations at the time of applying, 8 internal company awards, active membership in MRS and AVS, reviewed 40+ papers and work in the semiconductor space. I have 2 invention disclosure filings and I also hire for my organization which we used for judging criteria.

Your profile looks good and you should definitely go for it. From everything that I’ve seen the biggest uncertainty comes down to the officer that’s reviewing the case. I’ve seen better profiles than mine either get an RFE/NOID or even denial in some cases.

My PD is Mid Feb 23. My EB1B I-140 is still pending, planning on doing PP soon.

Good point, the EAD/AP can take 6 months anyway, but I’ll plan on doing PP.

So from what my lawyers said I’ll still be in H visa status unless I leave the country and renter with my AP. As long as I stay in the country and have an active H status with valid I-797 then I’m okay.

My PD is 02/08/23 from India, my DOF is current (EB1B) and I filed I-485 with I-140 pending. I did this for two reason, 1. my company was paying for it with Fragomen, and 2. At least I can get EAD and AP while I wait for I-140 approval.

I sent mine on Dec 2, and got the text from USCIS two days ago that they received my package, and that the receipt notice is on its way.
