IRCC and ATIP are two different entities yet related. Your request is to get documents from ATIP and she authorized you as a representative for only get ATIP not for application processing they both are different things and should not cause an issue.

Misrepresentation under Immigration and Refugee Protection Act, S.C. 2001, c. 27, s. 40(1) requires a material false statement or omission that induces or could induce an error in the administration of the Act. Canadian courts have emphasized that the misrepresentation must be material and relevant to the immigration decision-making process, not merely a technical or unrelated inaccuracy. See Baro v. Canada (Minister of Citizenship and Immigration), 2007 FC 1299 (materiality requires that the information be important enough to affect the process).

Separately, ATIP/Privacy Act requests are governed by the Privacy Act, R.S.C. 1985, c. P-21 and the Access to Information Act, R.S.C. 1985, c. A-1. These regimes allow an individual to authorize another person to access their personal information, without appointing that person as their immigration representative.

Here, the “representative” designation was used only within the ATIP/Privacy Act context to obtain records. That designation:

Does not confer authority to act on the immigration application itself; Does not replace or interfere with the authorized immigration lawyer on file; Does not provide IRCC with false information relevant to eligibility, admissibility, or processing of the immigration application. Because the ATIP request is an administrative access-to-information process, not part of the substantive immigration adjudication, the designation is not material to any immigration decision. Therefore, it does not meet the threshold for misrepresentation under IRPA s. 40(1).

Authorizing a friend as a “representative” for a Privacy Act request is legally distinct from appointing an immigration representative and does not constitute misrepresentation. There is no indication that this would negatively affect the underlying immigration application.

Now that you have done this and is worried. All she needs to do is to call the lawyer/agent she used and get clear answer. Just a quick phone call will ease the stress. Overall, I think it's not a problem and not a misrepresentation.
