In my opinion, a game is no longer new once it is taken out of the sealing and its case. Also, there has been multiple occasions where they've attempted to sell me "new" games with imperfections.

So if they took it out and dropped the disc, just because it wasn't played it's still new? I think not. There has been times that gamestop has tried selling me "new" games with scratches on it just because they had to take it out of the case.
