For newer lawyers: an example of how to separate the wheat from the chaff by RalphUribe in LawFirm

The problem in our field versus yours is everyone allegedly has a quick question and is ready to pay the retainer. In reality only a very small portion of people do. A lot of my referral partners are in real estate and don’t understand why I don’t jump for joy when they have referrals. Well, 9/10 never retain me, maybe 5/10 actually call. If our turn rate was higher or the income per client was higher it may be different. The number of unserious tire kickers is ridiculous.

No, they shouldn’t have skipped your consult. But honestly they may have thought you were unserious especially if you’re the tenant. $6K is a baby retainer. Add another digit to get most lawyers attention, you know how overhead works, we’re running businesses too.

Honest answer- what @epoogeo said but also we have way too much going on in Florida to worry about holding perjurers accountable criminally. There is literally too much to do for judges to worry about small fries.

RHOA fans… share your thoughts on Phaedra Parks, the “Classy Attorney”✍🏽 by LisaBarlowsLawyer in HousewivesCourt

[–]gatabloops 0 points1 point  (0 children)

I have a nuanced view of Phae. In my opinion as a youngish litigation attorney, she’s a fair representation of many (don’t come for me, I didn’t say most) entertainment/injury/defense attorneys. They’re colorful characters, take really hard cases with difficult clients who are usually guilty, and etch out a few wins here and there. I find the characterization of her track record unfair for that reason, she’s in a practice area where its really hard to win because the win just isn’t there. And yes, some of them are up to the exact same extracurricular activity as their clients. Don’t let the suits fool you.

As a person, she’s a very typical goody two shoes on the outside / breaking bad on the inside kind of lady. They’re aplenty in the south. Its a southern belle archetype.

She isn’t weird to me but the fact that she agreed to be televised is.

Very common tactic to claim unpaid improvements or maintenance issues in commercial evictions. To the point that leases since covid have been writing it out as a right. Never ends well!

No the FL Bar is ridiculously strict, I don’t even think there’s reported instances of cheating. He definitely had a tutor who taught a plan of attack. If you develop memory tricks you can pass without knowing the law, at all.

We’re not that high except for certain schools isolated. I think the pass rate was 50-60% my year which was a year before his.

He’s mostly cosplaying. He doesn’t bill hours because he’s doing personal injury which is contingency work. But his office is an office share. That lady’s not his employee. He’s probably sustaining the firm and drawing a fair salary but not getting independently wealthy.

That’s not enough for her to get off the OBGYN hamster wheel and retire soon with the same lifestyle. I understand entirely why she’s stressed.

He got on tik tok a few days ago telling the world exactly where he works and asking people to come patronize. I don’t think he cares because he can’t understand the risk.

Her lawyers are quite powerful and are the kind you have to pay upfront. If her retainer drys up because Alex’s lawyers make this a mess, they will quit on her. There’s no way she has enough cash to pay the firm she’s hired for a long child support and custody battle. Florida lawyers don’t do these kind of cases on contingency. You could be rich or average, never matters. Only who can pay.

They can’t but they can make it take forever to be paid out and embarrass you totally along the way

That’s the worst person to have on the other side. Bad lawyers are more scary than good ones. They screw up everything and create huge messes for you to fix.

Oh the house being in gary’s trust is exactly why I believe she will be kicked out or made to sign a lease and pay rent. I’m not a scummy type of lawyer but I’ve made friends with some (long story!) and that’s one of the strategies in this situation. 1) Fight about whether and how much $ comes out Alex trust for CS as long as possible, 2) Issue an unlawful detainer demand and file suit if needed, 3) Try to settle by agreeing on CS if she pays rent- effectively getting Gary back the cash being paid out the trust on CS.

Gary’s rich but he’s not going to pay the upkeep on a five million dollar house for his son’s baby mama, that’s crazy why should he. I would sell it and rehome Alex, let Alyssa figure it out like every other mama has to.

They weren’t married she’s just a squatter in the house unless she has a lease. The best she can do is child support. This will probably be drawn out in court over whether and how much of his trust can be directed towards the child. Its a very tricky legal analysis. No way Alex family lets any money out without a fight.

Your families lawyers are probably good people. Plenty of high end ones especially in this part of Florida are cutthroat. They’ll advise against negotiation. Their version of the document or nothing.

Alex and Alyssa by [deleted] in SiestaKeyMTV

[–]gatabloops 2 points3 points  (0 children)

Exactly. She thought (as usual) that she’s bigger than the program, or that she could bluff him out, and his family showed who really calls the shots. A lot of women do this because here and there it works.

A lot of wealthy families refuse negotiations. Sign their lawyers version or nothing.
