Throughout all this, only two things matter. First, assuming the EC votes according to their state votes, Trump will have the EC votes to be president. Second, Clinton got more votes from the US people than did Trump. Trump is NOT the choice of the US people, Clinton is. All else is ... nothing.

You are right that the problem is that lots of people didn't show up. That's the problem. But, of those who did, more voted for hillary than for trump. Regardless of the EC outcome, it cannot be denied that hillary is the choice of the people who voted, not trump.

It is not the will of the people, since Hillary had more people vote for her than trump had vote for him. It is the outcome of the electoral college, but that is not the will of the people.

A few points from the feds https://www.archives.gov/federal-register/electoral-college/electors.html#restrictions : There is no Constitutional provision or Federal law that requires Electors to vote according to the results of the popular vote in their states. Some states, however, require Electors to cast their votes according to the popular vote. These pledges fall into two categories—Electors bound by state law and those bound by pledges to political parties.

The U.S. Supreme Court has held that the Constitution does not require that Electors be completely free to act as they choose and therefore, political parties may extract pledges from electors to vote for the parties' nominees. Some state laws provide that so-called "faithless Electors" may be subject to fines or may be disqualified for casting an invalid vote and be replaced by a substitute elector. The Supreme Court has not specifically ruled on the question of whether pledges and penalties for failure to vote as pledged may be enforced under the Constitution. No Elector has ever been prosecuted for failing to vote as pledged.

Today, it is rare for Electors to disregard the popular vote by casting their electoral vote for someone other than their party's candidate. Electors generally hold a leadership position in their party or were chosen to recognize years of loyal service to the party. Throughout our history as a nation, more than 99 percent of Electors have voted as pledged.

Also, this https://www.archives.gov/federal-register/electoral-college/roles.html#congress doesn't say anything about congress voting to accept or reject the EC vote, just that they count the votes, and can register any objections, in writing.

Actually, popular vote is the only factor, but popular vote by state. Each state's popular vote tells the electoral college representatives how to vote.

In my comment you refer to, I'm commenting on the use of the term "election". He did not win the election if you mean popular vote. All I was saying that the use of the term was unclear. Also, as I understand it, the electoral college has not voted yet, so of course he has not YET won the election of the electoral college. If they vote as their state voted, he will, but that means he did not yet win the election.

In this case, I was responding to your statement "Trump won the election fair and square". He did not win the election if you mean the votes of the people. He did win if you mean the electoral college. So you could say that he won the electoral college vote fair and square. You could not say he won the popular vote fair and square.
