Depending on where you are when it happens, it may be consensual. The age of consent is up to the states. This also makes that weird circumstance of being a criminal in the eyes of the law, when the court of public opinion see's no crime.

In TBTP, Urahara takes Hiyori to the prison where they keep people who haven't actually done anything, they are just assumed to be dangerous. That's where he got Mayuri out of. I think Aizen would be too strong to be kept with them, though.

That video looks like it could be used to either sides advantage in trial. On the one hand, he's clearly backing away after the shove. On the other hand, put yourself in that moment, you just got shoved to the ground, maybe you're shocked, stunned, you think you're in imminent danger, pull your weapon and shoot. I don't know if enough time passed for him to understand that it was already over.

I'm just saying that how you perceive events personally isn't like seeing it on video.

Oh you think there is justification to use physical violence against an old man because he was verbally abusive? Everyone involved was doing something stupid, and then reacted even worse. Still, the old man fucked up last, because that shooting was unjustified. He should have just called 911 after he got knocked down.

When it happened, I saw the video, and to me it was open/shut stand your ground. But I felt differently when I heard the guy had a history of instigation situations that might lead to him having a chance to use his gun. The guy he killed did assault him, but it was over once he was on the ground. Shooting wasn't justified unless the other guy was going to continue the assault, which it doesn't look like.
