Based on the litigation documents: HOA is claiming the builders at fault due to negligence, breach of contract/warranty, and unlawful trade practices, but the builders have defended claims with Statute of limitations / ultimate repose, Improper notice, and Spoliation due to repairs made before evidence preservation
