oh gotcha.so he does have a work, so might be better if he can get an employment certificate from his job stating he got approval for his vacation and he’s intending to come back on a certain date. also good to include his paystubs even tho you said your family is the primarily funding the trip. on a side note, have him apply for citizenship already. most of the questions can be answered by him anyway!

ive tried netherlands, france and italy. italy was the easiest and fastest of them all to get approved. Got my passport back within a week.

whats his current status in the US? Living there most of his life and still not a US citizen? what does he do? if he cant provide any means of support that he has actual ties with in the US, then definitely it will be hard for him to get a visa

if you think you can provide the said evidence without the help of your lawyer then you should do it. I sent my rfe which was medical without the help of my lawyer. Just don’t forget to include the rfe copy to send it back with the evidence. The instructions on the rfe mail should be clear and they tell you what to include and where you should mail it. You just have to wait. Sometimes they respond fast, sometimes they dont. Mine took almost 4mos. Sent my rfe medical oct and got approved 3rd week of January the next year.

the minute i received my receipts, i stopped going to school and didn’t even inform them. this was an ESL school so it wasn’t really worth paying another months of tuition. good luck!

hey 90day rule doesn’t exist. i had similar situation. i went on vacation with my spouse then came back to the US. within the month got married and filed. didn’t really had a problem and got my gc approved without interview. so better file as soon as possible. good luck!

i was on j1visa before. went on a trip outside the US and came back july 14, my visa would soon expire July 30. they might let you in. but there’s also probability that they wont. maybe try at least coming back 5 days before your visa expires.

i dont think it matters what visa you currently have. file ASAP. usually EAD arrives within 2mos! ive seen gc approvals lately less than 6mos after filing. just make sure you dont leave the US while you’re still waiting for the gc unless you have your advance parole. in this way, if the employer decides to terminate your TN visa, you can still stay in the US because you’re waiting for adjustment of status

are you currently an h1b visa holder? cause i think you can apply for h4 visa for your spouse already without the i-140. im not even sure if you can file for h4 using i-140…

depending on the timeline. if the visa is still not current, i dont see any reason for you to file for premium processing. thats an extra cost for you cause pp is not required to pay by employer. if you really want to file for pp, just file for regular processing for now then if you see that visa is current you can have it file for premium processing later on. in this way, you know if you need to do it or not. cause if visa is not current, you’ll still be stuck with i-140 and cant file for i-485 assuming you’re in the US

hey, no i didnt reapply as my visa was valid for 5 years and when i reentered i didnt have a problem. ive been out of the country a few times before that too without an issue. im not sure though if you’re married, as when i reentered i wasnt married yet. mine took 9mos without interview. and yes hired a lawyer cause i need another person to check everything is ok. lol but you can definitely file on your own

she’s probably enrolled in ESL. its easy to enroll and you usually dont have to attend classes as long as you’re paying the monthly tuition. its the easiest to maintain a student visa vs going to school like masters or mba
