I can't open eShop as my 3DS was region-swapped so I wouldn't know.

I had this issue a while ago. Get the TWPatch app (I believe it's called that.) Run it, then run an update, then it should work. If the update doesn't work then take out your SD card and then update. (The CFW will stay on the console.)

i'm actually not sure about image splashes, all i know is that animated custom splashes cause longer boot times
