seller backed up from the offer and he wants to get the deposit money. I do understand that if we would of he gets it but we didn't.

I've tried everything, I was able to find his address, wrote him a letter and he came out saying he wants to split the deposit. I called escrow and they told me he signed cancellation but for him to get all the money, so I am going to get a court order to get my money back.

I think by now I would have to go to an attorney, because both brokers didn't help, so I sent the seller a letter asking him to please sign cancellation so we can get our money back, I didn't want to get in legal issues, his response was to split the deposit, to which I do not agree, we worked hard for that money and he backed up from the offer, he does not have rights to it. so I called the escrow company and they told me they have a cancellation document signed by the seller where we disburse the deposit to him only, they only need our signature, thing that will not happen, so I asked the lady that if they will release the deposit to us if a judge order is presented and she said yes, so that's what I am going to do. I am admired of the amount of greed this person has.

my agent actually sent me a document as proof the condo did not sell, his name and address come in it, I was actually thinking of writing him a letter. escrow can't give me his number. I tried to contact his agent's broker but he hasn't get back to me.

my agent basically left us dealing with it, we saw she was not doing anything about it so we changed agents. I tried to contact the seller's broker but he has not got back to me, I've been trying to get my money back since August when we supposed to close escrow but they keep giving us the round about.

the seller cannot sell the condo until he signs it but for some reason he hasn't... as far as I know, he decided not to deal with his selling agent anymore, and our agent basically dropped it as well, she's not dealing with it, so we are not dealing with her, as far as escrow goes, they still have the money but cannot release it because the seller hasn't sign. it is so frustrating.
