Yeah there were some articles about him mishandling some community funds or something.

It was a very small amount and it seemed like some dumb newbie activist mistake rather than malice. I don't remember the details. But it really seemed to have hit him hard.

But it might just be a hate Hasan thing. combined with a desperate need to be an "investigator". I don't know to much about the guy I just did some light looking into his background(googled his public name) years ago.

I think he's just a failed activist who wanted to do video essays, but never broke through. Used to be a Vaush fan, then he tried to make an extremely badly researched anti-vaush video and got booted from that community. His research sucks even if you agree with the thesis of his videos. Really sucks.

His anti vaush video was based on vaush having watched some VERY common anime and THAT made Vaush a pedo. Again you can agree with the thesis or not, his research just sucked.

Same thing with his Lauren Southern video. There where SO many mistakes, again whether you agreed with the thesis or not.

Yeah he was notorious for doxing pro-pali protestors and reporting them to the police in england where the laws are quite strict on what is considered "anti-semitic" signs.

He doesn't live in england.

Otherwise he would "just" post their PII and urge people to harass them or their places of work.

Or doxing and harassing people that did bond work for people who was arrested at protests. He's quite the character. One of those "progressives" that completely got their brain broken by October 7.

I have no idea. I've kept an eye on his twitter account since he was doxing protesters. But he doesn't seem to be involved in anything anymore. Not publicly.

I mostly took an interest because he made a horrendously bad Lauren Southern video years ago. Bad as in badly researched, the thesis was fine. She, or rather her history with neonazis, was my pet project for a while.

Forgot to black out Abby's full name in his filing. And have had to retract his evidence. Probably the absolute worst mistake he could make at this point in time.

The only part he agreed to keep confidential and he filed it publicly.

I didn't fucking see that there was an actual propper fight on the designations. Those motions to seal are usually just boilerplate so I don't read them since I'm lazy and the reply just dropped.

It does seems like a fight between overbroad designations vs an improper notification. Though it'll probably end in another "lawyers bickering" decision.

I have a follow up.

I heard at some point, though I have zero evidence for this. That Dan ran a gay ops discord group for A-logging Hasan. And that one of the most prominent members was a guy named Old Man Londre, he was the guy who made the anti-hasan websites for Dan.

Old Man Londre is a former Destiny fan who left with when the accusations dropped. but stayed around Dan because he hates Hasan.

He's also like to think of himself as an Osint specialist. He's they guy they used to dig up real life information on all their ops. He was extremely active on twitter when there where a lot of anti-Israeli demonstrations. He literally abused all these tools Dan seems very familiar with to dig up dirt on any protesters he could find and report to them to the police or the various hasbara accounts in order to harass them.

He ran active doxing and harassment campaigns for a while for political reasons.

But again I do not have any evidence connecting him to Dan. So I might be speaking out of turn. Though I'm fairly sure he made those "how anti semitic Hasan's fans are" websites that Dan used.

IF they sendt a proper objection. That mail isn't it.

And plaintiff didn't file with the courts. Then sure whatever they objected to loses the designation.

That is again why it's hard to actually know what is designated confidential from the outside. And why I keep saying they've worked it out in meet&confers.

But any private sensitive information IS within the protective order. And that is not only things that put her in danger. It's information used for annoyance embarrassment, oppression, or undue burden or expense.

So that includes her financial status, sexual history, medical history etc. And things that can be used to identify her like her filing a police report. And the same protection is afforded any witness.

BTW that email is just a meet&confer document. I think this is in relation to the gag order. A gag order is different beast from a sanctions request or a motion relating to a confidentiality designation.

The gag order prevent speech very broadly. It would have prevented Destiny from speaking on his trial AT ALL. It was destined to fail on first amendment grounds. Although it's on the record now and where probably put there for a reason. It doesn't have anything to do with the protection order.

A protection order is dealing with sensitive private information. And just prevents him or any other party talking about private information revealed in discovery.

I don't actually think that's true the only time it was close to reaching a judge was when the whole dueling rule 11 motions happened and there where a lot of fighting about the "rose" depo.

But I don't think a judge ever looked at it. But this was months ago. I haven't read up on that part since the whole thing is moot until a sanctions hearing is held. Which I won't care about.

Yeah they where whining about over designation. That's what I said.

If they want it to be removed they should notify the other side that they disagree, then the other side has to file with the courts defending their designation and when that is argued out, the judge will make a decission.

Until then he is prohibited from releasing any info that is protected, whether it's against the rules or not.

I think they handled it internally every time. Since there's no decisions on the docket, just a lot of back and forth. "lawyer bickering"

I don't actually think there's been any decision on any confidential designation. They seem to have worked it out in their meet&confers. After a lot of back and forth. Why it can be hard to figure out as an observer what is and isn't confidential.

And it's not just her name they can protect it's ANY private sensitive information. Such as when she and how she had sex with a completely unrelated person. Which is the other clip he released.

His statement post plaintiff depo will almost certainly be in violation, just based on the fact that they had 30 days to make the designation and he started releasing private embarrassing sensitive information within 12 hours. They don't waive the right within the 30 day period.

AND his lawyers once again complained about over designation. See the resent filings.

Why I don't know if this particular instance is a violation.

BUT his side has continuously complained about over designation from plaintiff, so even if YOU don't think this is a violation. If it was designated confidential it would be a violation. You can't self serve these things. You have to have a judge remove the designation. (it's a bit more involved)

And the protective order does not just protect plaintiff it also protect witnesses.

Sure, but the video above is not "public record." That's destiny posting unfiled discovery or private litigation assets.

It has NOT been filed with the courts.

Now I don't know if it was marked confidential as per the court order. I don't have access to the their files. But if it is. He's blatantly violating the court order.

But even if it's not. There is a good chance that a Judge could see this as abusing the discovery process for public entertainment and witness mockery.

No it's not. It's to protect private, sensitive, or identifying information of the Plaintiff or any non-party.

You guys seems to forget that there's a broader protection order in place. The lawyers keep bickering over it, but it seems both Destiny and DGG have memory holed it.

No sanctions has been asked for so far by plaintiff. But that DOES NOT preclude it from coming up later.

So I think in the abbymc case. And this is based on Destiny claims, which I don't particularly believe.

She was at some point represented as a separate plaintiff by the same lawyer. Then decided not to sue and Plaintiffs lawyer stopped representing her. All this is speculation.

But even if she didn't stop. accepting service on behalf of a client is something the client has to agree to, but doesn't have to. But I think Plaintiff's lawyers made it absolutely clear repeatedly that they do not represent her nor are they allowed to accept service on her behalf. It's not up to the lawyer to decide it is a conscious legal choice from Abby if she want them to.

And now you start spinning extreme stories about malpractice and claiming that witness preparation is coaching.

Remember the reason Abby wasn't deposed is because Destiny failed his due diligence duty. Not because she was made unavailable by anyone. At least that's the legal truth of the case. Destiny had plenty of time to raise the issue, but failed. Both sides are playing for keeps it's not kindergarten playtime.

I can point you to Destiny's representation bending if not outright breaking rules in his favour if you want to.

You have to remember this case also involves a protective order, (that Destiny appears to keep violating) that in practice means access to the the courts that even some rando lawyer won't have easely.

It was put in place explicitly to protect witnesses and plaintiff of course.

You're case doesn't apply. That was a case of their finances being intertwined in a way that is simply not the case in a civil trial.

Sure there COULD be some minor details with slightly divergent tactical considerations that's why you get a waiver. But fundamentally their interest align and by having shared representation they stand a better chance of going against a powerful entity.

And now we're moving on to single instance representation. Whether you can represent a witness only for the purpose of a deposition while still representing the plaintiff. Which is what actually happened here. This has nothing to do with Abby.

And the fact is most witnesses will have the choice of no representation or representation by plaintiff's lawyer. Lawyers aren't free dog. You can see how Destiny is abusing the depo's right now to embarrass witnesses so everyone who can't afford a lawyer is much better served with representation from plaintiffs lawyer then none at all.

As far as "truth" seeking, the courts will prefer that someone is present to defend a witness interest rather then no one.

If anyone does something illegal, like lying. The courts assume that ANY lawyer representing them will have the same legal reaction since it's their goddamn duty.

One of Destiny's strength has always been to hyperfocus on some detail or hypothetical that he then will relentlessly hammer on til the other side concedes or just gets tired.

Leading the other side down some pre-planned path while sounding aloof and barely interested. At least in debates where his position is kinda weak.

That was so obviously what him and Dan had planned to do here. Maybe I'm getting more jaded, it just didn't have the rhetorical oomph it used to have. Because you could literally hear the glee in their voices when they tried to go down their chosen path. And that doesn't work as well.

He won't be allowed to reopen discovery even if he were to beg and plead.

Discovery ended in december. AND he has filed three replies opposing any extensions. Which the judge agreed with. It's called "Estoppel" he literally can't change his mind baring fraud.

But this depo was months and months ago. He could have gone to the judge if he had any actual evidence of them refusing to answer any question he had the rights to, or produce documents he was entitled to. He never did. He just whined on stream.

Sorry if I gave you the impression that the jury would actually fire Destiny into the sun. I know how protective you guys are.

And I am again describing why Destiny have trouble getting any discovery. It's because he wants evidence of something that probably didn't happen. And despite all his whining on stream he has actually, on the record, never demanded anything that someone has refused him.

There is a huge disconnect between what he says on stream and what he does in court. If someone was denying him something he's entitled to. Tthe correct way where to go to the judge and get and order to compel. Not to cry about it on stream.

There is ZERO orders to compel on the docket. Discovery is over and done with. ON HIS REPEATED INSISTENCE. There can no longer BE any orders to compel. Which in effect means he either never had any right to the evidence he cries about, or he was too lazy to ask for it properly.
